LOCATION: 16241 Beach Boulevard, 92647 (northwest corner of Beach Blvd. and Holt Ave.) DATE OF ACTION: March 26, 2008 The Design Review Board of the City of Huntington Beach took action on your application(s) on March 13, 2008, and your application was recommended for approval to the Planning Department. On March 26, 2008, the Planning Department approved your application(s). Attached to this letter are the recommended conditions of approval of your application(s). Under the provisions of the Huntington Beach Zoning and Subdivision Ordinance, the action taken by the Planning Department becomes final at the expiration of the appeal period. A person desiring to appeal the decision shall file a written notice of appeal to the Secretary of the Planning Commission within ten calendar days of the date of the Planning Department's action. The notice of appeal shall include the name and address of the appellant, the decision being appealed, and the basis for the appeal. A filing fee shall also accompany the notice of appeal. AP No. 08-002 March 26, 2008 Page 2 of 4 The appeal fee is $1,287 for a single-family dwelling property owner appealing the decision on his/her own property. The appeal fee is $1569 for all other appeals. In your case, the last day for filing an appeal and paying the filing fee is Frida A ril 4 2008 at 5:00 m. Please be advised that the Director of Planning reviews the conceptual plan as a basic request for entitlement. The action taken by the Director of Planning does not presume issuance of building permits. Provisions of the Huntington Beach Zoning and Subdivision Ordinance are such that any application becomes null and void one year after final approval, unless actual construction has started. It is recommended that you immediately pursue completion of the conditions of approval and address all requirements of the Huntington Beach Zoning and Subdivision Ordinance in order to expedite the processing of your building permit application and the completion of your project. The conceptual plan should not be construed as a precise plan, reflecting conformance to all Zoning and Subdivision Ordinance requirements. Please note that there may be additional requirements prior to commencement of the project. Excepting those actions commenced pursuant to the California Environmental Quality Act, you are hereby notified that you have 90 days to protest the imposition of the fees described in this Notice of Action. I CONDITIONS OF APPROVAL DESIGN REVIEW NO. 2008-004 ADMINISTRATIVE PERMIT NO. 2008-002 CONDITIONS OF APPROVAL - DESIGN REVIEW NO. 08-004: The site plan, floor plans, and elevations received and dated January 18, 2008 shall be the conceptually approved design with the following modifications: a. The side walk located between the street side property line along Holt Avenue and the parking lot area shall be landscaped and irrigated. b. A 5 ft. minimum wide paving band shall be provided at each driveway entrance. c. The walls and doors of the existing trash enclosure shall be modified to match the colors and materials utilized for the proposed building remodel. d. A roof shall be utilized over the trash enclosure compatible with the proposed colors and materials of the building remodel. The roof shall be sloped to ensure that all run off is concentrated onto the subject property. e. The architectural "eyebrow" located on the building's easterly exterior elevation shall increase the width of the fascia a minimum one ft. to provide a variation in roof lines. f. The trees proposed in the planter area adjacent to Beach Boulevard shall be re- placed with Palm trees or similar low-profile foliage subject to the approval of the City' Landscape Architect. CONDITIONS OF APPROVAL - ADMINISTRATIVE PERMIT NO. 08-002: 1. The site plan and floor plan received and dated February 20, 2008 shall be the conceptually approved layout. 2. Prior to the issuance of certificate of occupancy, the property owner shall submit an irrevo- cable offer of reciprocal access (easement) between the subject site and adjacent northerly property. The easement shall stipulate that the subject property owner(s) shall be responsi- ble for making necessary improvements on their respective properties to implement the re- ciprocal access. The legal instrument shall be approved by the Planning Department and the City Attorney as to form and content and, when approved, shall be recorded in the Office of the County Recorder prior to issuance of certificate of occupancy. A copy of the recorded document shall be filed with the Planning Department for inclusion in the entitlement file prior to issuance of certificate of occupancy. The recorded agreement shall remain in effect in perpetuity, except as modified or rescinded pursuant to the expressed written approval of the City of Hunting Beach. The applicant and/or applicant's representative shall be responsible for ensuring the accu- racy of all plans and information submitted to the City for review and approval. 2. Design Review No. 08-004 and Administrative Permit No. 08-002 shall not become effective until the ten-calendar day appeal period has elapsed. 3. Design Review No. 08-004 and Administrative Permit No. 08-002 shall become null and void unless exercised within one year of the date of final approval or such extension of time as may be granted by the Director pursuant to a written request submitted to the Planning De- partment a minimum 30 days prior to the expiration date. 4. The Planning Department reserves the right to revoke Design Review No. 08-004 and Ad- ministrative Permit No. 08-002, pursuant to a public hearing for revocation, if any violation of these conditions or the Huntington Beach Zoning and Subdivision Ordinance or Municipal Code occurs. 5. The development shall comply with all applicable provisions of the Municipal Code, Building Department, and Fire Department as well as applicable local, State and Federal Fire Codes, Ordinances, and standards, except as noted herein INDEMNIFICATION AND HOLD HARMLESS CONDITION: The owner of the property which is the subject of this project and the project applicant if different from the property owner, and each of their heirs, successors and assigns, shall defend, indem- nify and hold harmless the City of Huntington Beach and its agents, officers, and employees from any claim, action or proceedings, liability cost, including attorney's fees and costs against the City or its agents, officers, or employees, to attack, set aside, void or annul any approval of the City, including but not limited to any approval granted by the City Council, Planning Com- mission, or Design Review Board concerning this project. The City shall promptly notify the ap- plicant of any claim, action or proceeding and should cooperate fully in defense thereof.
