LOCATION: 16306 Niantic Circle (Terminus of Niantic Circle, west of Mistral Drive) DATE OF ACTION: November 25, 2003 Dear Mr. Grimes, The Planning Department reviewed and Approved your request on November 25, 2003 for a Waiver of Development Standards in accordance with Section 241.22 of the Huntington Beach Zoning and Subdivision Ordinance (HBZSO). Attached to this letter is the finding for denial for your application. Under the provisions of the Huntington Beach Zoning and Subdivision Ordinance, the action taken by the Planning Department becomes final at the expiration of the ten-day appeal period. A person desiring to appeal the decision shall file a written notice of appeal to the Secretary of the Planning Commission within ten calendar days of the date of the Planning Department's ac- tion. The notice of appeal shall include the name and address of the appellant, the decision being appealed, and the grounds for the appeal. A filing fee shall also accompany the notice of appeal. The appeal fee is $485 for a single-family dwelling property owner appealing the decision on his/her own property. The appeal fee is $1,540 for all other appeals. FINDING FOR APPROVAL ADMINISTRATIVE APPROVAL NO. 03-06 FINDINGS FOR PROJECTS EXEMPT FROM CE A: The Department of Planning finds that the project will not have any significant effect on the en- vironment and is exempt from the provisions of the California Environmental Quality Act (CEQA) pursuant to Section 15305 of the CEQA Guidelines because the project consists of a minor alteration in land use limitations which will not result in any changes in land use or den- sity. FINDINGS FOR APPROVAL: 1. The proposed construction of an elevator shaft at a side yard setback of 4'-6" and allowance of lot coverage at 50.6%, does not exceed ten percent deviation from the 5'-0" required side yard setback and maximum allowed lot coverage of 50% in the RL-CZ (Residential Low Density - Coastal Zone) base zoning district. 2. The requested waiver improves the design of the project by providing efficient internal circu- lation for a handicapped resident. The proposed design utilizes high quality building materi- als, architectural interest by the use of the cornice, while ensuring no detrimental impacts to surrounding properties. 3. Notwithstanding the request for a six-inch reduction in the side yard setback and 0.6% in- crease in lot coverage, the proposed second story addition does not require approval of any discretionary permits, and will not in any way degrade the environment or result in any changes to land use. With the exception of the proposed six-inch reduction in the side yard setback and 0.6% increase in lot coverage, the proposed addition conforms to all applicable development standards, including maximum lot coverage, maximum height, and minimum separation between structures. CONDITIONS OF APPROVAL - ADMINISTRATIVE APPROVAL NO. 03-04: 1. The site plan, floor plan and elevations received and dated November 25, 2003, shall be the conceptually approved layout. 2. The applicant and/or applicant's representative shall be responsible for ensuring the accuracy of all plans and information submitted to the City for review and approval. INFORMATION ON SPECIFIC CODE RE UIREMENTS: 1. Administrative Approval No. 03-06 shall not become effective until the ten calendar day appeal period has elapsed. 2. The use shall comply with all applicable provisions of the Municipal Code, Building Divi- sion, and Fire Department as well as applicable local, State and Federal Fire Codes, Ordi- nances, and standards, except as noted herein.
