I FINDINGS AND CONDITIONS OF APPROVAL ADMINISTRATIVE APPROVAL NO. 04-05 FINDINGS FOR PROJECTS EXEMPT FROM CE A: The Department of Planning finds that the project will not have any significant effect on the environment and is exempt from the provisions of the California Environmental Quality Act (CEQA ) pursuant to Sec- tion 15301 of the CEQA Guidelines because the project consists of a minor alteration to an existing single family dwelling FINDINGS FOR APPROVAL: 1 The proposed 23 ft 10 in setback to the opposite side of the alley (turning radius), as modified by the conditions of approval, does not exceed a ten percent (10%) deviation from the minimum required 25 ft setback in Section 231 18 D, Residential Parking Requirements, pursuant to Section 210 06 of the Huntington Beach Zoning and Subdivision Ordinance To provide the maximum amount of space for a vehicular egress/i n cress, a conditioned has been placed on the project to increase the turning radius to maximum distance possible, 23 ft 10 in , by reducing the depth of the garage to the minimum al- lowed by code The proposed 23 ft 10 in setback, as modified, in lieu of the minimum required 25 ft 0 in setback improves the design of the project by facilitating the reconstruction of the existing single family home with a parking garage that complies with the minimum required depth of 19 ft The new single family home will be designed with a Mediterranean theme, which will enhance the appearance of the neighborhood In addition, reconstruction of the single family home will include public improvements to the alley Furthermore the applicant proposes to provide intensified landscaping along the alley be- tween the new single-family home and southerly property line improving the appearance of the alley as seen from Alabama Street 3 The proposed 23 ft 10 in setback, as modified, in lieu of the minimum required 25 ft 0 in setback would not otherwise require any discretionary permits, and will not in any way degrade the environ- ment or result in any changes to land use With the exception of the proposed 23 ft 10 in turning ra- dius, the proposed addition conforms to all applicable development standards, including floor area ra- tio, lot coverage, landscaping requirements, and setbacks Mr Mathews/ AA 04-05 June 10, 2004 Pace 4 of 4 CONDITIONS OF APPROVAL - ADMINISTRATIVE APPROVAL NO. 04-05: 1 The site plan and floor plans recLived and dated May 25, 2004, shall be the conceptually approved layout with the following modifit ations a The interior depth of the thie_ -car garage shall be decreased to a maximum of 19 feet b The garage shall provide a m -iimum 6 ft 4 in setback from the exterior side property line (af- ter dedication) c A landscaped planter with int_ 'zsified landscaping shall be provided in the area between the single family home and the exterior side properly line 2 Prior to submittal for building per .iits, the following shall be completed a Submit a copy of the revised s to plan, floor plans and elevations pursuant to Condition No I for review and approval and ui_ fusion in the entitlement file to the Planning Department b Zoning entitlement conditions if approval shall be printed verbatim on one of the first three pages of all the working drax i,ig sets used for issuance of building permits (architectural, structural, electrical, mechanic <1 and plumbing) and shall be referenced in the sheet index The minimum font size utilized foi tai inted text shall be 12 point INDEMNIFICATION AND HOLD HARMLESS CONDITION: The owner of the property which is the subject of this project and the project applicant if different fiom the property owner, and each of their heirs successors and assigns, shall defend, indemnify and hold harmless the City of Huntington Beach an(-' its agents, officers, and employees from any claim, action or proceedings, liability cost, including attoi nc"V's fees and costs against the City or its agents, officers or em- ployees, to attack, set aside, void or annul _.iy approval of the City, including but not limited to any ap- proval granted by the City Council, Planniit` Commission, or Design Review Board concerning this pro- ject The City shall promptly notify the app.icant of any claim, action or proceeding and should cooperate fully in the defense thereof
