The Huntington Beach Planning Department has completed preliminary review of
the floor plan, elevations, and site plan for a proposed first and second floor
addition, in conjunction with an attached accessory unit located at 9571 Albacore
Drive Comments from the Planning Department include the following
1 The development matrix on sheet A-1 of the submitted plans is inaccurate
and shall be revised to reflect the correct percentage of lot coverage
(Page A-1 has been updated and reflects correct percentage of lot
coverage)
2 The driveway that is proposed to provide access to the rear garage shall
be omitted because it does not comply with the minimum driveway
requirements as established by the Public Works Department (contact the
Public Works Department for the specific requirements)
(Please see A-1 measurements shows compliance with Public Works
Department requirements)
3 A minimum 40% of the front yard area shall be landscaped The plans
shall reflect conformance with the aforementioned requirement on the
submitted site plan (A-1)
(Please see revised A-1 front yard landscaped)
4 To demonstrate adherence to the residential infill ordinance, a percentage
of the existing walls removed due to the remodel or construction of
additional floor area shall be provided on the submitted floor plan
(Please see revised A-1 wall % to be removed)
5 One additional off-street parking space shall be required for the proposed
accessory dwelling in a location onsite that does not obstruct the ingress
and egress of onsite parking spaces
(Please see revised A-1 with compliance with Public Works Department
requirements for driveway approached we are complying with the parking
requirements)
The plans should be revised based on these comments and shall be resubmitted
to the Planning Department for completion of the review process

Declaration of Covenants, Conditions and Restrictions Affecting Real
Property
This Declaration of Covenants, Conditions and Restrictions are made as of
October 1, 2007, by Richard L. Taylor, hereinafter referred to as
"Declarant".
WHEREAS, Declarant is the owner of the real property located at 9751
Albacore Drive in the City of Huntington Beach (hereinafter referred to as
the "Subject Property ") more particularly described as Lot 81 in Tract
4852 in the City of Huntington Beach , County of Orange, State of
California; and
Declarant has applied to the City of Huntington Beach (hereinafter
referred to as the "City") for permission to construct a 642 sq. ft. livable
accessory dwelling unit in conjunction with a remodel single-family
dwelling on the Subject Property; and
Declarant desires to establish certain covenants, conditions and
restriction which shall run with the Subject Property for the purpose of
enhancing and protecting the value, desirability and attractiveness of the
Subject Property.
NOW THEREFORE, Declarant does hereby certify, agree and declare that
the Subject Property, and each portion thereof, shall be held, used,
leased, sold, and conveyed subject to each and all of the covenants,
conditions and restriction contained herein, each and all of which are
hereby declared to be for the benefit of all the Subject Property and each
portion thereof, and each present and future owner thereof, and
Declarant. These covenants, conditions and restrictions shall run with the
Subject Property and each portion thereof, and shall be binding upon all

parties having or acc ring any right, title or interest in& Subject
Property or any portion thereof, and shall inure to the benefit of and bind
each owner thereof and their respective successors in interest , and are
imposed upon the Subject Property and each and every portion thereof as
the dominant tenement or tenements, all of which follows, to wit:
That the main dwelling or accessory dwelling unit on the subject
property will be owner-occupied, as approved and authorized by
the City pursuant to Building Permit No. C2007 -006384, and
Administrative Permit No. 07-011.
2. That there shall be no changes , alterations , or deletions to the main
dwelling and accessory dwelling unit without the express prior
written approval of the City first had and obtained.
3. That these covenants, conditions and restriction shall run with the
Subject Property in perpetuity , and shall be binding upon the
undersigned Declarant owner , his heirs, successors , and assigns,
and any future owners of the Subject Property and their heirs,
successors and assigns, unless otherwise released by written
instrument approved and authorized by the City.
IN WITNESS WHEREOF , Declarant has executed this instrument on the
day and year first above written.
