LOCATION: 14501 Calneva Lane (northwest corner of Spa Dr. and Calneva Lane) DATE OF ACTION: April 7, 2004 Dear Mr. and Mrs. Preece: The Planning Department of the City of Huntington Beach reviewed your request to deviate from the minimum required side yard setback of five (5) feet by six (6) inches in accordance with Section 241.22 of the Huntington Beach Zoning and Subdivision Ordinance. The Planning Department approved your request on February 17, 2004, for a Waiver of Development Standards. Attached to this letter are the find- ings and recommended conditions of approval for your application. You must submit this notice of action letter to the Planning and Building & Safety Departments upon request for a Building Permit. Under the provisions of the Huntington Beach Zoning and Subdivision Ordinance, the action taken by the Department of Planning is final unless an appeal is filed to the Planning Commission by you or by an in- terested party. Said appeal must be in writing and must set forth in detail the action and grounds by which the applicant or interested party deems himself aggrieved. Said appeal must be accompanied by a filing fee of Four Hundred Eighty Five dollars ($485.00). The appeal shall be submitted to the Secretary of the Planning Commission within ten (10) calendar days of the date of the Department of Planning's action. The last day for filing an appeal and paying the filing fee for the above noted application is April 19, 2004. FINDINGS FOR APPROVAL: 1. The proposed 4'-6" inch side yard setback does not exceed a ten percent (10%) deviation from the minimum required 5'-0" side yard setback applicable in the RL (Residential Low Density) base zoning district, pursuant to Section 210.06 of the Huntington Beach Zoning and Subdivision Ordinance. 2. The proposed six (6) inch projection into the required 5'-0" side yard setback improves the design of the project by allowing the construction of a third car garage in an area between the existing two car garage and the nearest property line. The location of the proposed third garage along the northerly side property line will minimize the appearance of the garages from the public right-of-ways. Compliance with the side yard setback would require that the third car garage be construct elsewhere on the prop- erty, disrupting the entrance to the dwelling and significantly affecting the character of the neighbor- hood. 3. The proposed 4'-6" inch side yard setback would not otherwise require any discretionary permits, and will not in any way degrade the environment or result in any changes to land use. With the exception of the proposed 4'-6" inch side yard setback and the interior dimensions of the proposed garage, the proposed addition conforms to all applicable development standards, including maximum height, and minimum front and side yard setbacks. A condition is placed on the project requiring that interior di- mensions of the garage be increased to a minimum of 9' x 19' and remain clear of any obstructions. CONDITIONS OF APPROVAL - ADMINISTRATIVE APPROVAL NO. 04-04: 1. The site plan, floor plan and elevations received and dated March 2, 2004, shall be the conceptu- ally approved layout. 2. No obstructions such as the proposed dryer shall be allowed within the 9' x 19' space (interior di- mensions) required for a third car garage. 3. Increase the interior depth of the third car garage to 19 feet. 4. The man door within the proposed third car garage shall open to the outside. Mr. and Mrs. Preece/ AA 04-04 April 8, 2004 Page 4 of 4 INDEMNIFICATION AND HOLD HARMLESS CONDITION: The owner of the property which is the subject of this project and the project applicant if different from the property owner, and each of their heirs, successors and assigns, shall defend, indemnify and hold harmless the City of Huntington Beach and its agents, officers, and employees from any claim, action or proceedings, liability cost, including attorney's fees and costs against the City or its agents, officers or em- ployees, to attack, set aside, void or annul any approval of the City, including but not limited to any ap- proval granted by the City Council, Planning Commission, or Design Review Board concerning this pro- ject. The City shall promptly notify the applicant of any claim, action or proceeding and should cooperate fully in the defense thereof.
