LOCATION: 327 17th Street, 92648 (southwest corner of 17th Street and Orange Avenue) DATE OF ACTION: December 9, 2008 Dear Mr. Orozco: On December 9, 2008 the Department of Planning of the City of Huntington Beach APPROVED your request for a waiver of development standards. Attached to this letter are the findings and conditions of approval for your application. Under the provisions of the Huntington Beach Zoning and Subdivision Ordinance, the action taken by the Department of Planning is final unless an appeal is filed to the Planning Commission by you or by an interested party. A person desiring to appeal the decision shall file a written notice of appeal to the Secretary of the Planning Commission within ten calendar days of the date of the Department of Planning's action. The notice of appeal shall include the name and address of the appellant, the decision being appealed, and the grounds for the appeal. Said appeal must be in writing and must set forth in detail the action and grounds by which the applicant or interested party deems himself aggrieved. Administrative Permit No. 08-0 December 9, 2008 Page 3 of 4 ATTACHMENT NO. 1 0 FINDINGS FOR APPROVAL - ADMINISTRATIVE PERMIT NO. 08-024: 1. The proposed lot coverage of 54.3 percent does not exceed a 10% deviation from the maximum allowed lot coverage of 50% applicable in the RMH-A (Residential Medium-High Density - Small Lot) zoning district, pursuant to Section 210.06 of the Huntington Beach Zoning and Subdivision Ordinance. 2. The waiver of development standards improves the project design by allowing an addition of 886 sq. ft. of building floor area and 616 sq. ft. of deck/balcony area to an existing single-family dwelling while minimally impacting lot coverage and maintaining adequate open space on the lot. The existing wood shingle and tile exterior facade of the dwelling will be stuccoed to be consistent with the architectural character of the surrounding neighborhood. The addition provides balconies/decks as usable open space as well as architectural articulations to the building exterior. Furthermore, the project will ensure no detrimental impacts to surrounding properties by complying with required side and rear yard setbacks and maximum height limits. The proposed addition will not impact on-site parking requirements by providing for-no net increase in the number of bedrooms. 3. The proposed addition would not otherwise require any discretionary permits, and will not in any way degrade the environment or result in any changes to land use or density. With the exception of the proposed 54.3 percent lot coverage, the proposed addition conforms to all applicable development standards, including maximum height and floor area ratio, minimum yard setbacks and required on-site parking. The existing dwelling will continue to be used for single-family residential purposes after construction of the proposed addition. CONDITIONS OF APPROVAL - ADMINISTRATIVE PERMIT NO. 07-015: 1. The site plan, floor plans, and elevations received and dated November 25, 2008, shall be the conceptually approved layout. 2. Prior to submittal for building permits conditions of approval shall be printed verbatim on one of the first three pages of all the working drawing sets used for issuance of building permits (architectural, structural, electrical, mechanical and plumbing) and shall be referenced in the sheet index. The minimum font size utilized for printed text shall be 12 point. INDEMNIFICATION AND HOLD HARMLESS CONDITION: The owner of the property which is the subject of this project and the project applicant if different from the property owner, and each of their heirs, successors and assigns, shall defend, indemnify and hold harmless the City of Huntington Beach and its agents, officers, and employees from any claim, action or proceedings, liability cost, including G:\P LANNING\Administrative Permits\2008\AP 08-024 (327 17th) - Vonlossberg Residence.doc Administrative Permit No. 08-024 December 9, 2008 Page 4 of 4 attorney's fees and costs against the City or its agents, officers or employees, to attack, set aside, void or annul any approval of the City, including but not limited to any approval granted by the City Council, Planning Commission, or Design Review Board concerning this project. The City shall promptly notify the applicant of any claim, action or proceeding and should cooperate fully in the defense thereof. INFORMATION ON SPECIFIC CODE REQUIREMENTS 1. The applicant and/or applicant's representative shall be responsible for ensuring the accuracy of all plans and information submitted to the City for review and approval. 2. Administrative Permit No. 08-024 shall not become effective until the ten-calendar day appeal period has elapsed. 3. Administrative Permit No. 08-024 shall become null and void unless exercised within one year of the date of final approval or such extension of time as may be granted by the Director pursuant to a written request submitted to the Planning Department a minimum 30 days prior to the expiration date. 4.
