Your application was acted upon by the Planning Department of the City of Huntington Beach
on January 18, 2005, and your request was Conditionall A roved. Included in this letter are
the Conditions of Approval for this application. You must submit this notice of action letter to
the Building Department upon requests for Certificate of Occupancy or Building Permit.
Under the provisions of the Huntington Beach Zoning and Subdivision Ordinance, the action
taken by the Planning Department becomes final at the expiration of the ten-day appeal period.
A person desiring to appeal the decision shall file a written notice of appeal to the Secretary of
the Planning Commission within ten calendar days of the date of the Planning Department's ac-
tion. The notice of appeal shall include the name and address of the appellant, the decision being
appealed, and the grounds for the appeal. A filing fee shall also accompany the notice of appeal.
The appeal fee is $485.

CONDITIONS OF APPROVAL - LIMITED NOTIFICATION NO. 04-20
1. The floor plans received and dated December 27, 2004, shall be the conceptually approved
layout.
2. The maximum square footage of outdoor dining under Limited Notification No. 04-20 shall
not exceed 400 square feet.
3. The applicant and/or applicant's representative shall be responsible for ensuring the accuracy
of all plans and information submitted to the City for review and approval.
INFORMATION ON SPECIFIC CODE RE UIREMENTS:
1. Limited Notification No. 04-20 shall not become effective until the ten-calendar day appeal
period has elapsed.
2. Limited Notification No. 04-20 shall become null and void unless exercised within one year
of the date of final approval or such extension of time as may be granted by the Director
pursuant to a written request submitted to the Planning Department a minimum 30 days
prior to the expiration date.
3. The Planning Department reserves the right to revoke Limited Notification No. 04-20, pur-
suant to a public hearing for revocation, if any violation of these conditions or the Hunting-
ton Beach Zoning and Subdivision Ordinance or Municipal Code occurs.
4. The development shall comply with all applicable provisions of the Municipal Code, Build-
ing Department, and Fire Department as well as applicable local, State and Federal Fire
Codes, Ordinances, and standards, except as noted herein.
5. A Certificate of Occupancy must be approved by the Planning Department and issued by
the Building and Safety Department prior to occupying the building.
