Location: _ 3301 Devon Circle, Huntington Beach Dear Mr. Scott: NOTICE IS HEREBY GIVEN that the Planning Department has reviewed your entitlement application, received and dated Jul 24 2006, and has determined the application to be incomplete. The following information and/or corrections are requested in order for the Planning Department to deem your application complete and continue the review process of your application: MINIMUM APPLICATION RE UIREMENTS The following items are necessary to deem your application complete: 1. Presently, the existing front yard setback varies from 6'-11" to 13'. The existing rear yard setback is 9'-4". The required front and rear yard setbacks for the subject property are 15' and 10', respectively. In order to construct an addition at the existing nonconforming setbacks, you should revise your pending Conditional Use Permit application by submitting a revised project narrative indicating a request to construct the addition at the existing nonconforming setbacks. CODE RE UIREMENTS The following items are identified as not complying with minimum code requirements: Notice of Filing Status: CUP No. 06-29/CDP No. 06-12 August 22, 2006 Page 2 of 2 1. Per Section 210.06-M-1-d of the HBZSO, third story habitable area shall be within the confines of the second story roof volume. Presently, the proposed third story is not confined within the volume of the second story roof. Reconfigure the roof plan to accommodate the third story within the confines of the second story roof volume. If you do not choose to revise your plans you may submit a variance request, which can be added to your current application package. The fee for applying for a variance is $2,446. 2. Per Section 210.06-M-1-d of the HBZSO, third story windows in the form of dormers may be permitted as vertical projections above the roof volume provided the projections are set back 5 feet from the building exterior. The elevations indicate several third story windows are not confined within the second story roof volume and are located at the building exterior. Comply with code by designing the third floor windows as dormers setback five (5) feet from the building exterior. For your reference, I have attached a copy of Section 210.06-M-1 of the HBZSO. OTHER DEPARTMENTS COMMENTS Comments from other City departments will be provided to you as soon as they are received by the Planning Department. Please submit the above-noted information and/or corrections as soon as possible in order for the Planning Department to continue the review process of your request. Location : 3301 Devon Circle, Huntington Beach Dear Mr. Scott: NOTICE IS HEREBY GIVEN that the Planning Department has reviewed the above Coastal Development Permit application received and dated July 24, 2006 & the Administrative Permit application received and dated June 20, 2007 and has deemed the application complete and accepted for processing. Your item is tentatively scheduled before the Zoning Administrator on Wednesday, August 1, 2007 at 1:30 pm (Room B-8, lower level). You will receive an agenda and executive summary of the staff report in the following weeks. If the Zoning Administrator approves your application, a check in the amount of $50 and payable to the County of Orange must be received within three days of the approval. This check represents the fee necessary to post a Notice of Exemption stating that the project is exempt from the California Environmental Quality Act.
