REQUEST: To permit the construction of an 83 s.f., 11 ft. tall gazebo with a four-foot
six-inch side and rear yard setback, in lieu of a five -foot setback.

Dear Applicant:
Your application was acted upon by the City of Huntington Beach Department of Planning on February 5,
2003, and your request was Conditional) A roved. Attached to this letter are the findings and condi-
tions of approval.
Please be advised that the Department of Planning reviews the conceptual plan as a basic request for enti-
tlement of the use applied for and there may be additional requirements prior to issuance of building per-
mits. It is recommended that you immediately pursue completion of the conditions of approval and ad-
dress all requirements of the Huntington Beach Zoning and Subdivision Ordinance in order to expedite the
processing/completion of your total application. The conceptual plan should not be construed as a precise
plan, reflecting conformance to all Zoning and Subdivision Ordinance requirements.
Under the provisions of the Huntington Beach Zoning and Subdivision Ordinance, the action taken by the
Department of Planning is final unless an appeal is filed to the Planning Commission by you or by an in-
terested party. Said appeal must be in writing and must set forth in detail the action and grounds by which
the applicant or interested party deems himself aggrieved. Said appeal must be accompanied by a filing
fee of Three Hundred Forty-Seven Dollars ($347.00) if the appeal is filed by a single family dwelling prop-
erty owner appealing the decision on his/her own property and One-Thousand Sixty-Three Dollars
($1,063.00) if the appeal is filed by any other party. The appeal shall be submitted to the Secretary of the
Planning Commission within ten (10) calendar days of the date of the Department of Planning's action.
The last day for filing an appeal and paying the filing fee for the above noted application is February 17,
2003.

Provisions of the Huntington Beach Zoning and Subdivision Ordinance are such that any application be-
comes null and void one (1) year after the final approval, unless actual construction has begun.

FINDINGS AND CONDITIONS OF APPROVAL - ADMINISTRATIVE APPROVAL NO. 03-01
FINDINGS FOR PROJECTS EXEMPT FROM CE A:
The Department of Planning finds that the project will not have any significant effect on the environment
and is exempt from the provisions of the California Environmental Quality Act (CEQA) pursuant to Sec-
tions 15303 and 15305 of the CEQA Guidelines because the project consists of construction a small ac-
cessory structure together with a minor alteration in land use limitations in an area with less than 20%
slope, which will not result in any changes in land use or density.
FINDINGS FOR APPROVAL:
1. The proposed four-foot six-inch side and rear yard setbacks do not exceed ten percent deviation from
the five-foot side and rear yard setbacks applicable to detached accessory structures in the RL (Resi-
dential Low-Density) base zoning district.
2. The requested waiver improves the design of the project by increasing the usable yard area, while en-
suring no detrimental impacts to surrounding properties. The gazebo roof will encroach 14 inches into
the required setbacks, whereas the Huntington Beach Zoning & Subdivision Ordinance allows projec-
tions up to 30 inches.
3. Notwithstanding the request for a six-inch reduction in side and rear setbacks, the proposed gazebo
does not require approval of any discretionary permits, and will not in any way degrade the environ-
ment or result in any changes to land use. With the exception of the proposed four-foot six-inch side
and rear yard setbacks, the proposed gazebo conforms to all applicable development standards, includ-
ing maximum lot coverage, maximum height, and minimum separation between structures.
CONDITIONS OF APPROVAL - ADMINISTRATIVE APPROVAL NO. 03-01:
1. The site plan, floor plan and elevations received and dated January 4, 2003, shall be the conceptually
approved layout.
2. The applicant and/or applicant's representative shall be responsible for ensuring the accuracy of all
plans and information submitted to the City for review and approval.
INFORMATION ON SPECIFIC CODE RE UIREMENTS:
1. Administrative Approval No. 03-01 shall not become effective until the ten calendar day appeal pe-
riod has elapsed.
2. The use shall comply with all applicable provisions of the Municipal Code, Building Division, and
Fire Department as well as applicable local, State and Federal Fire Codes, Ordinances, and standards,
except as noted herein.
3. A building permit shall be obtained for the proposed gazebo.
