LOCATION: 7402 Edinger Ave. (south side of Edinger Ave, east of Gothard St) ACTION DATE: May 22, 2007 The Planning Department of the City of Huntington Beach reviewed and approved your application on May 22, 2007. Attached to this letter are the findings and conditions of approval of your application. Under the provisions of the Huntington Beach Zoning and Subdivision-Ordinance, the action taken by the Planning Department becomes final at the expiration of the ten-day appeal period unless appealed by the property owner. To appeal the decision, the property owner shall file a written notice of appeal to the Secretary of the Planning Commission within ten calendar days of the date of the Planning Department's action. The notice of appeal shall include the name and address of the appellant, the decision being appealed, and the grounds for the appeal. A filing fee shall also accompany the notice of appeal. The appeal fee is $494. In our case the last da for filin an a eal and a in the filin fee is June 1 2007. Due to unique circumstances, the sign's immediate removal will result in a substantial hardship for the applicant. The applicant is requesting permission to allow the existing sign to remain so that its removal and replacement can be budgeted. 2. The sign will not adversely affect other lawfully erected signs in the area and will not result in visual clutter due to the fact that there are no freestanding signs visually affected by the existing sign. 3. The sign will not be detrimental to properties located in the vicinity . The sign will identify the building correctly and will allow visitors in the general area to easily locate the property. 4. The sign will be in keeping with the character of the surrounding area and will be refaced to complement the building on the subject property. 5. The sign will not obstruct vehicular or pedestrian traffic visibility and will not be a hazardous distraction. The sign does not conflict with vehicle or pedestrian visibility along Edinger Avenue. CONDITIONS OF APPROVAL - LIMITED SIGN PERMIT NO. 2007-002: 1. Limited Sign Permit No. 2007-002 shall be valid for up to two years from the date of approval (May 22, 2007). At that time the existing 35-fo t high freestanding sign shall be removed. +Z o sun D s-5tlo .-t 2. Prior to issuance of building permits, the property owner shall file a cash bond in the amount of with the City for the purpose of indemnifying the City for any and all costs incurred in the removal of the existing 35-foot high freestanding sign. If the sign is not made to conform with the applicable provisions of the sign ordinance after two (2) years from May 22, 2007, the city of Huntington Beach or its agents or employees may enter on the property where said signs are located and remove said signs and the cost of removal shall be deducted from the cash bond and summarily forfeited and paid over to the City of Huntington Beach, and the remainder, if any, returned to the person depositing the bond. 3. The Planning Department reserves the right to rescind this limited sign permit approval in the event of any violation of the terms of the applicable zoning laws. Any such decision shall be preceded by notice to the applicant and a public hearing and shall be based on specific findings. INDEMNIFICATION AND HOLD HARMLESS CONDITION: The owner of the property which is the subject of this project and the project applicant if different from the property owner, and each of their heirs, successors and assigns, shall defend, indemnify and hold harmless the City of Huntington Beach and its agents, officers, and employees from any claim, action or proceedings , liability cost , including attorney's fees and costs against the City or its agents, officers or employees , to attack, set aside, void or annul any approval of the City, including but not limited to any approval granted by the City Council , Planning Commission, or Design Review Board concerning this project. The City shall promptly notify the applicant of any claim, action or proceeding and should coop- erate fully in the defense thereof.
