Gallonio, 17392 Chapparal Lane, Huntington Beach, CA 92649 REQUEST: To permit a waiver of development standard, pursuant to Section 241.22 of the Huntington Beach Zoning & Subdivision Ordinance, to permit a 13 ft. 6 in. front yard setback in lieu of the minimum 15 ft. associated with the construction of an approximately 400 sq. ft. first floor addition to an existing single-family residence. LOCATION : 17392 Chapparal Lane, 92649 (north of Nordina Drive, east of Chapparal Lane) DATE OF ACTION : April 20, 2010 Dear Mr. Stellrecht: On April 20, 2010, the Planning Department of the City of Huntington Beach took action on your request and APPROVED your request with conditions. Attached to this letter are the conditions of approval for your application. - Please be advised that the Department of Planning reviews the conceptual plan as a basic request for entitlement of the use applied for and there may be additional requirements prior to issuance of building permits. It is recommended that you immediately pursue completion of the conditions of approval and address all requirements of the Huntington Beach Zoning and Subdivision Ordinance in order to expedite the processing/completion of your project. The conceptual plan should not be construed as a precise plan, reflecting conformance to all Zoning and Subdivision Ordinance requirements. I Administrative Permit No. 10-00 April 20, 2010 Page 2 of 2 0 Under the provisions of the Huntington Beach Zoning and Subdivision Ordinance, the action taken by the Department of Planning is final unless an appeal is filed to the Planning Commission by you or by an interested party. A person desiring to appeal the decision shall file a written notice of appeal to the Secretary of the Planning Commission within ten (10) calendar days of the date of the Planning Department's action. The notice of appeal shall include the name and address of the appellant, the decision being appealed, and the grounds for the appeal. A filing fee of $494 shall also accompany the notice of appeal. Said appeal must be in writing and must set forth in detail the action and grounds by which the applicant or interested party deems himself aggrieved. The project which consists of an approximately 400 sq. ft. first floor addition to an existing single-family residence will improve the building design by providing greater articulation to the building's front fagade with incorporation of variable offsets, elevation breaks, a recessed front entry, contrasting building materials and hipped roof design. The architectural improvements provide further shadow and relief which enhances the building's overall architectural interest. The project will not be a detriment to surrounding properties because the 1 ft. 6 in. encroachment is limited to a 20 sq. ft. area of the addition which assists to articulate the front facade. The project, with exception of the 1 ft. 6 in. reduction in the front yard setback, will comply with development requirements of the base zoning district in terms of minimum onsite parking and side and rear yard setbacks, and maximum building height and lot coverage. 2. The proposed addition will be a compatible continuation of the front building facade. The addition will enlarge the existing first floor and will not raise the overall height of the existing building. The residence will be consistent with the overall appearance, scale, and size of other existing one- and two-story homes located in the surrounding area. 3. The enlargement of the residence by approximately 400 sq. ft. will increase the overall size of the building to 2,790 sq. ft. The 1 ft. 6 in. encroachment into the minimum 15 ft. front yard setback will result in a 10 percent deviation, which is the maximum deviation allowable per Section 241.22 of the Huntington Beach Zoning and Subdivision Ordinance. CONDITIONS OF APPROVAL - ADMINISTRATIVE PERMIT NO. 10-007: 1. The site plan, floor plans, and elevations received and dated April 1, 2010, shall be the conceptually approved layout. a. Option No. 2 shall be the approved design for the fagade of the front (west) elevation. b. On Sheet No. A-1, A-2, and A-2, depict the roof eaves with a maximum width of 1 ft. 6 in. along the building's front fagade. 2. During demolition, grading, site development, and/or construction, the following shall be adhered to: a. Construction equipment shall be maintained in peak operating condition to reduce emissions. b. Use low sulfur (0.5%) fuel by weight for construction equipment. c. Truck idling shall be prohibited for periods longer than 10 minutes. d. Attempt to phase and schedule activities to avoid high ozone days first stage smog alerts. e. Discontinue operation during second stage smog alerts. Ensure clearly visible signs are posted on the perimeter of the site identifying the name and phone number of a field supervisor to contact for information regarding the development and any construction/grading activity. 3. The structure(s) cannot be occupied and the final building permit(s) cannot be approved until the following has been completed: a. All improvements must be completed in accordance with approved plans, except as provided for by conditions of approval. b. Compliance with all conditions of approval specified herein shall be verified by the Planning Department. c. All building spoils, such as unusable lumber, wire, pipe, and other surplus or unus- able material, shall be disposed of at an off-site facility equipped to handle them. 4. Prior to submittal for building permits conditions of approval shall be printed verbatim on one of the first three pages of all the working drawing sets used for issuance of building permits (architectural, structural, electrical, mechanical and plumbing) and shall be refer- enced in the sheet index. The minimum font size utilized for printed text shall be 12 point. 5. Incorporating sustainable or "green" building practices into the design of the proposed structures and associated site improvements is highly encouraged. Sustainable building practices may include (but are not limited to) those recommended by the U.S. Green Build- ing Council's Leadership in Energy and Environmental Design (LEED) Program certification (htt ://www.us bc.or /Dis la Pa e.as x?Cate o ID=19) or Build It Green's Green Build- ing Guidelines and Rating Systems (htt ://www.buildit reen.or /index.cfm?fuseaction= uidelines). INDEMNIFICATION AND HOLD HARMLESS CONDITION: The owner of the property which is the subject of this project and the project applicant if different from the property owner, and each of their heirs, successors and assigns, shall defend, indemnify and hold harmless the City of Huntington Beach and its agents, officers, and employees from any claim, action or proceedings, liability cost, including attorney's fees and costs against the City or its agents, officers or employees, to attack, set aside, void or annul any approval of the City, including but not limited to any approval granted by the City Council, Planning Commission, or Design Review Board concerning this project. The City shall promptly notify the applicant of any claim, action or proceeding and should cooperate fully in the defense thereof. INFORMATION ON SPECIFIC CODE REQUIREMENTS 1. The applicant and/or applicant's representative shall be responsible for ensuring the accuracy of all plans and information submitted to the City for review and approval. 2. Administrative Permit No. 10-007 shall not become effective until the ten-calendar day appeal period has elapsed. 3. Administrative Permit No. 10-007 shall become null and void unless exercised within one year of the date of final approval or such extension of time as may be granted by the Director pursuant to a written request submitted to the Planning Department a minimum 30 days prior to the expiration date. The development shall comply with all applicable provisions of the Municipal Code, Building Department, and Fire Department as well as applicable local, State and Federal Fire Codes, Ordinances, and standards, except as noted herein.
