Dear Mr. Hartman,
This letter is in response to the plans you submitted for an Initial Plan and Zoning Review
(IPZR) dated February 9, 2000. A list of comments and changes that need to be made in
order for it to be compliant with the Huntington Beach Zoning and Subdivision
Ordinance (HBZSO) are as follows:
1. The yard located on Lake Street is considered a street side yard and must adhere to
street side yard requirements. The minimum setback according to the HBZSO
Chapter 210.06(H) (1) is 10 ft. The current setback is 4 ft, thus causing the structure
to be legal nonconforming.
2. The legal nonconforming status of your residence, due to the street side yard setback
(Lake Street), requires you to adhere to Chapter 236.06 (D) of the HBZSO, in order to
construct the new garage at the same setback:
"Additions to nonconforming structures proposed to be constructed at the existing
nonconforming yard setbacks shall be subject to approval of a Conditional Use Permit
(CUP) permit by the Zoning Administrator (ZA)."
A CUP application and Chapter 236 Nonconforming Uses and Structures of the
HBZSO have been included in this letter.
3. According to the HBZSO Chapter 230.08 Accessory Structures, the maximum height
of a garage is 15 ft and the distance between buildings on the same lot shall not be
less than 10 ft.
4. The proposed 6 ft block wall along Lake Street and on the side yard is allowed
according to the HBZSO Chapter 230.88 (A) (2):
"Fences or walls a maximum of six (6) feet in height may be located in required side
and rear yards, except as excluded in this Section. Fences or walls exceeding six (6)
feet in height may be located in conformance with the yard requirements applicable to
the main structure except as provided for herein or in the regulations of the district in
which they are located."
The 6 ft block wall proposed on the front yard (Crest Street) will not be allowed
according to HBZSO Chapter 230.88 (A) (1):
"Fences or walls a maximum of forty-two (42) inches in height may be located in any
portion of a lot ... Fences or walls -exceeding forty-two (42) inches in height may not
be located in the required front yard, except permitted elsewhere in this section."
Exceptions to these requirements require approval of a CUP by the ZA.
A copy of Chapter 230.88 Fencing and Walls has been included with this letter.
5. The proposed side yard setback of 3 ft is allowable.
6. Once plans are submitted, Public Works will determine how to address the removal of
the current driveway and construction of the new driveway, curb and gutter on Crest
Avenue.
