No. 01-29 G&A Job #4200 Dear Mary Beth and Susan: Per my conversation with Susan on Wednesday October 17 2001 we are submitting this letter for your consideration and approval on two items: the orientation of doors on the trash enclosure and the electrical transformer location. TRASH ENCLOSURE DOORS Our client, JE Pistons, has requested that the trash enclosure doors be rotated 90 degrees,Lct2z11 from facing south to facing east, for three reasons. 1. They feel it will be more attractive to not have the doors visible from the street. The entire portion of the east property line that is fronted by the parking area is not visible, as the existing industrial building that extends along this full parking area has no windows. Further, because it is a property line condition, this building could not have windows cut into it without the approval of JE Pistons and the recordation of a yard affidavit, neither action which is pending or anticipated. 2. Our client is concerned that the previously-approved location of the trash enclosure could possibly be at risk of damage by an automobile, a trash truck or a delivery truck, and could possible damage one of these, in the event the gates were inadvertently left open. Note that by rotating the trash enclosure we have provided a 6'-4" clear space from the enclosure to the nearest parking stall. 3. Having the doors on the east side will make putting trash into the enclosure easier for our client and will allow them to enter the enclosure out of the traffic aisle. ELECTRICAL TRANSFORMER Currently, as designed, the electrical transformer is shown as an above-grade model, in the southwest corner of the property, approximately 7' east of the face of curb, and approximately 10' north of the south property line. Our property has a 6' utility easement from the face of curb, then a 10' basic front yard setback from the back of this easement, and then an additional 8'-6" building height setback. Because the side is adjoined by another industrial property, we do not have a side yard setback. Condition G of item 1 of the Conditions of Approval, dated June 28, 2001, states that an electrical transformer in a required front or side yard must be in a subsurface vault. Susan informed us that this requirement was enacted into the Huntington Beach code in 1994. In the industrial tract our project is located in, bounded by McFadden on the south, Graham on the west, Bolsa on the north, and Springdale on the east, there are only two other undeveloped parcels besides ours. All other parcels are built out with industrial buildings. All of these developments that we are aware of have the electrical transformers above ground, and most of them are within about 6' of the face of curb. This includes the new building directly across the street from our building, on the southwest corner of Machine Drive and Electronic Lane. This structure was built during 1998 and 1999, four to five years after the underground requirement was placed into the code. We have provided a picture, attachment no. one, that shows this building and the transformer. Note that this transformer is located approximately 6' from the face of the curb. We have also included pictures of nine other buildings, on three of the immediate streets, showing similar conditions. Please see attachments two through ten. Clearly, enforcement of this code item places an unreasonable hardship on our client by imposing excessive costs that no other development has had to comply with. Even the newest development across the street in attachment no. one was given an exemption to this requirement, even though they were built after enactment. We are requesting that you grant us the same exemption and that it be done administratively on the basis of precedents being set before and after enactment of the code. We are asking that this approval be administrative to avoid a public hearing, which we believe is not required when precedent is set and there are clearly no adverse impacts, as is the case here. Time is of the essence, as we are ready to begin construction within the next two to three weeks. Any public hearing would cause a lengthy delay and cost impact to construction and operation of the facility by our clients. Thank you for your consideration , time and assistance. Parking areas for more than 250 parking spaces should provide interior planting islands with minimum 135 sq. ft. of plantable area every 10 parking spaces. These landscaping areas should be planted with shade trees, low shrubs and groundcover and should be protected by a 6-inch high curb on all sides and a 12-inch wide concrete step-off area adjacent to parking spaces. e. This is the panel that faces the parking lot (facing south), and that is approximately 36" thick on the street side (west). This is similar to the design we had previously submitted, and is what we have shown on the accompanying plans. This will create a signature "monolith" effect for the entry. They are strongly opposed to raising any other parapets along the west street side of the project; they feel, and I concur, that doing so would minimize the impact of an accent at the front entry. Combined with the color scheme, this will define the entry of the building in a manner we feel is consistent with the City's design guidelines, and reflects a general trend in newer industrial design we have seen around the region. 2. They want to keep the window mullions as we have shown on the accompanying plan. We feel this is more consistent with the contemporary design they are striving for, with it's emphasis on horizontal lines in the glazing. 3. The accompanying plans show the color scheme they want. We have made a few minor modifications from what we had previously shown, including making the top band at the parapet the darker blue (which matches their corporate logo).
