Dear Mr. Burrola:
On August 1, 2001 the Planning Director for City of Huntington Beach considered and conditionally a -
prove d a request to reface a legal non-conforming pole sign at the subject site. Included in this letter are
the Findings and Conditions of Approval for this application.
FINDINGS OF APPROVAL - LIMITED SIGN PERNIIT 01-01
1. Due to unique circumstances, the sign's immediate removal will result in a substantial hard-
ship for the applicant. The applicant is requesting the face change of an existing pole sign in
order to identify a restaurant which, because of its location in an IG (Industrial General)
zone, does not have the same visibility onto the property as do properties in the CG (General
Commercial) zone.
2. The sign will not adversely affect other lawfully erected signs in the area. The sign will not
block visibility of any lawfully erected signs in the area and will not result in visual clutter
due to the fact that there are no freestanding signs visually affected by the existing sign.
3. The sign will not be detrimental to properties located in the vicinity. The sign will identify
the building correctly and will allow visitors in the general area to easily locate the property.
4. The sign will be in character with the surrounding area and will be refaced to compliment
the building on the subject property.
5. The sign will not obstruct vehicular or pedestrian traffic visibility and will not be a hazard-
ous distraction. The sign does not conflict with vehicle or pedestrian visibility along Edinger
Avenue.
CONDITIONS OF APPROVAL - LIMIT ED SIGN PERMIT 01-0
1. Limited Sign Permit No. 01-01 shall be valid for up to two (2) years or upon issuance of
building permit for a new non-conforming sign, whichever comes first.

2. Prior to issuance of building permits for the face change, the applicant shall file a cash bond
in the amount of $5,000 for the purpose of indemnifying the City for any and all costs in-
curred in the removal of the freestanding sign. If the sign is not made to conform with the
applicable provisions of the sign ordinance by August 1, 2003 , the City of Huntington Beach
or its agents or employees may enter on the property where said sign is located and remove
the sign. The cost of the removal shall be deducted from the cash bond and summarily for-
feited and paid over to the City of Huntington Beach, and the remainder, if any, returned to
the person depositing the bond. The bond shall be posted no later than 30 days from the ap-
proval of Limited Sign Permit 01-01 (by September 1, 2001).
3.The Director reserved the right to rescind this limited sign permit approval in the event of
any violation of the terms of the applicable zoning laws. Any such decision shall be pre-
ceded by notice to the applicant and a public hearing and shall be based on specific findings.
Under the provisions of the Huntington Beach Zoning and Subdivision Ordinance Code, the action taken
by the Director is final unless an appeal is filed to the Planning Commission by you or an interested party.
Said appeal must be in writing and must set forth in detail the action and grounds by and upon which the
applicant or interested party deems himself aggrieved . Said appeal must be accompanied by a filing fee
of six hundred and ninety dollars ($690) and be submitted to the City Clerk's office within ten 910) days
of the date of the Director's action.
In case your case, the final day for filing an appeal and paying the filing fee is August 13, 2001.
