In general, the vacation of public streets, highways and service easements is governed by the California Streets and Highways Code sections 8300 et seq. The vacation can follow either a summary or non-summary procedure, and both of these procedures are set forth below. In regard to the quitclaim deed, this office does not recommend that public easements, once vacated, be subsequently quitclaimed to the to the underlying property owner. As noted below, if the City Council determines the public easement should be vacated without reservations, the vacation will be recorded in the County Recorder's office and the underlying fee owner will then hold title to the property free from the easement. Therefore, a quitclaim deed is neither necessary nor advisable. 1. NON-SUMMARY VACATION PROCESS a. Planning Commission Prior to vacating a street or public service easement that is within the City's general plan, the City Council must consider the City's general plan and submit the matter of the proposed vacation to the Planning Commission, pursuant to the procedures established under Government Code Section 65402. Within 40 days or some other period designated by the City Council, the Planning Commission must make a report as to whether the vacation is in conformance with the General Plan. If the Planning Commission fails to make its report, it will be conclusive evidence the vacation is in conformity with the General Plan. (California Streets and Highways Code § 8313; Government Code §62540.) Page 2 Robert Beardsley RLS 06-533 b. Initiation of Proceedings The City Council may initiate vacation proceedings by setting a hearing on the proposed vacation. The date of the hearing shall not be less than 15 days after the initiation of proceedings. (California Streets and Highways Code § 8320.) c. Hearing and Notice The notice of the hearing on the proposed vacation must contain: (1) the time, date, and place of the hearing, and (2) a description of the street or public service easement proposed to be vacated and a reference to a map or plan that shows the area to be vacated and includes a statement that the vacation proceeding is conducted under California Streets and Highways Code Chapter 3. In the case of a street, the description must include its general location, its lawful or official name or the name by which it is commonly known, and the extent to which it is to be vacated. In the case of an easement, the description must identify it with common certainty. The map or plan showing the location of the street or easement satisfies this description requirement. (California Streets and Highways Code § 8320.) The City Clerk must publish notice of the hearing for at least two (2) successive weeks prior to the hearing, in a daily, semiweekly, or weekly newspaper published and circulated within the City. (California Streets and Highways Code § 8322.) The Department of Public Works, on behalf of the City, must post conspicuous notices of the vacation along the street or easement proposed to be vacated at least two (2) weeks before the day set for the hearing,. The notices must be posted no more than 300 feet apart, and at least three (3) notices must be posted. If the street or easement to be vacated exceeds one (1) mile in length, the department may, instead of posting not more than 300 feet apart, post notices at each intersection of another street with the street or easement to be vacated, and at one point approximately midway between each intersection, but at least three (3) notices shall be posted. (California Streets and Highways Code § 8323.) d. Receipt of Evidence At the hearing, the City Council must hear evidence offered by interested persons. e. Resolution Vacating the Easement If the City Council finds, from all the evidence submitted, that the street or easement is unnecessary for present or prospective public use, it may adopt a resolution vacating the street or easement. - ti 06-533/4695 • Page 3 Robert Beardsley RLS 06-533 f. Conditions The resolution may provide that the vacation occurs only after conditions required by the City Council have been satisfied and may instruct the clerk that the resolution of vacation not be recorded until those conditions have been satisfied. (California Streets and Highways Code § 8324.) g. Recordation The City Clerk must record the resolution of vacation in the office of the county recorder. From the date of recordation and compliance with conditions, if any, the vacation is complete. (California Streets and Highways Code § 8325.) h. Reservations i. Future Sewers , Storm Drains and,Other Utilities • In a proceeding to vacate a street, the City Council may reserve from the vacation the easement and right at any time to construct, maintain, operate, replace, remove and renew sanitary sewers and storm drains and appurtenant structures in, upon, over or across the street to be vacated, and pursuant to any existing franchises, to construct, maintain, operate, replace, remove, renew and enlarge pipes and other structures, equipment and fixtures for the operation of gas pipelines, telegraphic and telephone lines, railroad lines, and for the transportation and distribution of electrical energy, petroleum, ammonia and water. (California Streets and Highways Code § 8340.) ii. Future Streets The City Council may reserve and except an easement for a future street unless it finds the street is unnecessary for prospective public use. (California Streets and Highways Code § 8340.) iii. Existing Utilities If there are public utility facilities in place that are in use, the City Council should, unless it determines the public convenience and necessity require otherwise, reserve and except from the vacation any easement and right necessary to maintain, operate, remove, replace or renew the public utility facilities. (California Streets and Highways Code § 8340.) i. Effect of Vacation of Easement • Unless the City Council makes any reservations described above, the vacation of an easement extinguishes all public easements therein. (California Streets and Highways Code § 8350.) If the City owns only an easement, title to the property previously subject to the easement reverts to the owner of the fee free from the easement. (California Streets and Highways Code § 8351.) (California Streets and Highways Code § 8355.) II. SUMMARY VACATION PROCESS a. In General Under certain circumstances, a city may use a summary procedure for vacating a portion of a street. Summary vacation procedures are not available if there are in-place public utility facilities that are in use and that would be affected by the vacation. (California Streets and Highways Code §§ 8330 et seq, 834.5.) b. Circumstances in which Summary Vacation May Occur L Superceded by Relocation The street has been superseded by relocation, unless such vacation would: (1) cut off all access to a person's property which, prior to relocation, adjoined the street, or (2) terminate a public service easement unless the easement meets the criteria for summary vacation of a public easement (see below). (California Streets and Highways Code § 8330.) ii. Impassability and Non-Maintenance The street has been impassable for vehicular traffic for five years and no public money has been expended for maintenance during such period. (California Streets and Highways Code § 8331.) iii. Surplus An excess right-of-way of a street is not required for street purposes. (California Streets and Highways Code § 8334.) iv. Dead-Ends A portion of a street lies within property under one ownership and does not continue through such ownership or end touching the property of another. (California Streets and Highways Code § 8334.) v. Public Service Easements Cities may summarily vacate public service easements where: (1) the easement has not been used for the purpose for which it was dedicated or acquired for five consecutive years immediately preceding the vacation, or (2) the date of dedication or acquisition is less than five years and more than one year, immediately preceding the proposed vacation and the easement was not used is 06-533/4695 • Page 5 Robert Beardsley RLS 06-533 continuously since that date, or (3) the easement has been superceded by relocation and there are not other public facilities located within the easement. The Planning Commission need not review summary vacation of public service easements. (Government Code § 65402.) ii. Recordation The resolution of vacation must then be recorded in the Orange County Recorder's Office. From the date of such recording the vacation will be complete.
