LOCATION : 505 Crest Avenue (at 12`h Street) PROJECT PLANNER: Ron Santos Dear Applicant: Your application was acted upon by the City of Huntington Beach Department of Planning on October 16, 2003, and your request was Approved. Attached to this letter are the findings and conditions of approval. Please be advised that the Department of Planning reviews the conceptual plan as a basic request for enti- tlement of the use applied for and there may be additional requirements prior to issuance of building per- mits. It is recommended that you immediately pursue completion of the conditions of approval and ad- dress all requirements of the Huntington Beach Zoning and Subdivision Ordinance in order to expedite the processing/completion of your total application. The conceptual plan should not be construed as a precise plan, reflecting conformance to all Zoning and Subdivision Ordinance requirements. Under the provisions of the Huntington Beach Zoning and Subdivision Ordinance, the action taken by the Department of Planning is final unless an appeal is filed to the Planning Commission by you or by an in- terested party. Said appeal must be in writing and must set forth in detail the action and grounds by which the applicant or interested party deems himself aggrieved. Said appeal must be accompanied by a filing fee of Three Hundred Forty Seven Dollars ($347.00) if the appeal is filed by a single family dwelling property owner appealing the decision on his/her own property and One Thousand Sixty Three Dollars ($1063.00) if the appeal is filed by any other party. The appeal shall be submitted to the Secretary of the Planning Commission within ten (10) calendar days of the date of the Department of Planning's action. The last day for filing an appeal and paying the filing fee for the above noted application is October 26, 2003. • ATTACHMENT NO. 1 0 FINDINGS AND CONDITIONS OF APPROVAL - ADMINISTRATIVE APPROVAL NO. 03-35 FINDINGS FOR PROJECTS EXEMPT FROM CE A: The Department of Planning finds that the project will not have any significant effect on the environment and is ex- empt from the provisions of the California Environmental Quality Act (CEQA) pursuant to Section 15305 of the CEQA Guidelines because the project consists of a minor alteration in land use limitations in an area with less than 20% slope, which will not result in any changes in land use or density. FINDINGS FOR APPROVAL: 1. The proposed one-foot street-side yard setback encroachment does not exceed ten percent deviation from the ten foot street side yard setback requirement applicable in the RL (Residential Low-Density) base zoning dis- trict, pursuant to Section 210.06 of the Huntington Beach Zoning and Subdivision Ordinance. 2. The proposed project improves the design of the project by facilitating completion of a dwelling currently under construction on an irregularly shaped lot. The dwelling is designed with multiple offsets and breaks in the walls planes located along the side yard street frontage, in accordance with the City's Urban Design Guidelines. This Administrative Approval also takes into account that the subject dwelling exceeds the required street side yard setback on average, that a one foot dedication for street widening along the subject property's street side yard was required by the City, and that an error occurred in establishing the setback during the construction of the dwelling. 3. The proposed dwelling does not otherwise require any discretionary permits, and will not in any way degrade the environment or result in any changes to land use. With the exception of the proposed one-foot street side yard setback encroachment, the proposed dwelling conforms to all applicable development standards, including maximum lot coverage, maximum height, and minimum side yard setbacks. The proposed one-foot reduction in required street side yard setback will not result in significant environmental impacts since the proposed en- croachment is limited to approximately five sq. ft, and will occur along a street side yard. CONDITIONS OF APPROVAL - ADMINISTRATIVE APPROVAL NO. 03-35: 1. The site plan, floor plan and elevations received and dated September 22, 2003 shall be the conceptually ap- proved layout. 2. The applicant and/or applicant's representative shall be responsible for ensuring the accuracy of all plans and information submitted to the City for review and approval. INFORMATION ON SPECIFIC CODE RE UIREMENTS: 1. Administrative Approval No. 03-35 shall not become effective until the ten calendar day appeal period has elapsed. 2. The use shall comply with all applicable provisions 'of the Municipal Code, Building Division, and Fire De- partment as well as applicable local, State and Federal Fire Codes, Ordinances, and standards, except as noted herein. AA No. 03-05 October 16, 2003 Page 2 of 3 Provisions of the Huntington Beach Zoning and Subdivision Ordinance are such that any application be- comes null and void one (1) year after the final approval, unless actual construction has begun.
