HE IS BETTER QUALIFIED TO ADDRESS THE TECHNICAL ASPECTS OF THIS REQUEST. PLEASE CONSIDER THAT WE HAVE BEEN VERY ACCOMODATING IN REVISING THE SETBACKS FOR THIS PROPERTY IN SPITE OF THE UNUSUAL SHAPE OF THE LAND. IT WAS A VERY DIFFICULT PROCESS SINCE THE OLD PROPERTY HAD SETBACKS AS LOW AS 6 & 8 FEET TO THE EXISTING SIDEWALK ACROSS THE FRONT OF THE PROPERTY - WE CHANGED THAT SETBACK TO 10 FEET ACROSS THE ENTIRE 150' FRONTAGE ON CREST AVENUE, CAUSING US TO GIVE UP A LARGE PORTION OF LAND. THE CURRENT PROBLEM AROSE WHEN THE CITY DEDICATED AN ADDITIONAL 1 FOOT TO THE SIDEWALK AFTER OUR ARCHITECTURAL AND ENGINEERING PLANS HAD ALREADY BEEN COMPLETED . THE 1 FOOT DEDICATION WAS NEVER MENTIONED DURING PREVIOUS VISITS TO THE CITY BY MYSELF AND THE ARCHITECT . OUR SURVEY SHOWED THE 10' SETBACK WAS TO THE EXISTING SIDEWALK . CREST AVENUE CURVES AROUND THE PROPERTY , MAKING IT EXTREMELY DIFFICULT TO TAKE MEASUREMENTS TO A CURVED SIDEWALK AND CURB. THE 2 MINOR DISCREPANCIES , WHICH TOTAL APPROXIMATELY 4.5 SQUARE FEET (SEE PLANS ) WERE DISCOVERED WHEN THE PROPERTY WAS BEING STAKED BY THE SURVEYOR. THEY ARE TRULY MINOR INTRUSIONS AND THEY WOULD NOT HAVE EXISTED WITH A 10- FOOT SETBACK TO THE "EXISTING SIDEWALK ". I RESPECTFULLY REQUEST YOUR FAVORABLE CONSIDERATION IN THIS MATTER AS ANY DELAYS OR DESIGN CHANGES TO THE NEW PROPERTY AT THIS LATE STAGE OF DEVELOPMENT WOULD BE VERY DIFFICULT TO INCORPORATE AND WOULD RESULT IN A SUBSTANTIAL FINANCIAL HARDSHIP FOR US.
