Included in this letter are the findings and rec- ommended conditions of approval for this application. You must submit this notice of action letter to the Building Department upon request for Building Permits. Under the provisions of the Huntington Beach Zoning and Subdivision Ordinance, the action taken by the Department of Planning is final at the expiration of the ten-day appeal period. A person desiring to appeal the decision shall file a written notice of appeal to the Secretary of the Planning Commission within ten calendar days of the date of the Planning Department's action. The notice of appeal shall in- clude the name and address of the appellant, the decision being appealed, and the grounds for the ap- peal. A filing fee shall also accompany the notice of appeal. The appeal fee is $485 for a single-family dwelling property owner appealing the decision on his/her own property. The appeal fee is $1,540 for all other appeals. Said appeal must be in writing and must set forth in detail the action and grounds by which the applicant or interested party deems himself aggrieved. Findings and Conditions of Approval for Administrative Permit No. 04-13 c: Herb Fauland - Principal Planner Wayne Carvalho - Associate Planner / Plan Check File Gerald Caraig - Building and Safety Eric Engberg - Fire Department Steve Bogart - Public Works AP No. 04-13 May 10, 2005 Page 3 of 4 ATTACHMENT NO. 1 FINDINGS AND CONDITIONS OF APPROVAL - ADMINISTRATIVE PERMIT NO. 04-13 FINDINGS FOR PROJECTS EXEMPT FROM CEQA: The Department of Planning finds that the project will not have any significant effect on the environment and is exempt from the provisions of the California Environmental Quality Act (CEQA) pursuant to Sec- tion 15305 of the CEQA Guidelines because the project consists of a minor alteration in land use limita- tions in an area with less than 20% slope, which will not result in any changes in land use or density. FINDINGS FOR APPROVAL: 1. The proposed two-car garage at a setback of four-feet six-inches does not exceed ten percent devia- tion from the minimum five-foot. setback and the 112 square foot addition complies with all applicable development standards in the Huntington Beach Zoning and Subdivision Ordinance. 2. The proposed project improves the design of the project by allowing the garage at a,four-foot six- inch setback for the following reasons: . The new two-car garage replaces an existing one-car garage and brings the property into greater conformity with current development standards and requirements. The proposed project, in addition to the exterior improvements to the existing dwelling. will be compatible in the design, colors and materials. Will ensure no detrimental impacts to surrounding properties by complying with required side and rear yard setbacks for the main structure. 3. The proposed addition will not in any way degrade the environment or result in any changes to land use. With the exception of the six-inch reduction to the rear yard setback, the proposed addition conforms to all applicable development standards, including maximum height, minimum garage di- mensions, minimum side-yard setbacks and required on-site parking. 4. The proposed addition is necessary to secure added safety due to the existing condition of the one- car garage. Additionally, the proposed two-car garage addition and exterior improvements to the ex- isting structure will bring the structure's architecture into greater conformance with the surrounding neighborhood. 5. The proposed two-car garage and 112 square foot office addition will be consistent in height with the existing structure. 6. The existing duplex and garage consists of 1,411 square feet; whereas, the new addition will in- crease the structure to 1,515 square feet. The alterations will increase the floor area by 104 square feet or 7.4 percent, which is under the maximum 10 percent as required by the Huntington Beach Zoning and Subdivision Ordinance. AP No. 04-13 May 10, 2005 Page 4 of 4 CONDITIONS OF APPROVAL - ADMINISTRATIVE PERMIT NO. 04-13 1. The floor plans received and dated September 28, 2004, shall be the conceptually approved layout. 2. The applicant and/or applicant's representative shall be responsible for ensuring the accuracy of all plans and information submitted to the City for review and approval. 3. The conditions of approval and code requirements identified herein, shall be printed verbatim on one of the first three pages of all the working drawing sets used for issuance of building permits (architectural, structural, electrical, mechanical and plumbing) and shall be referenced in the sheet index. The minimum font size utilized for printed text shall be 12 point. 4. The owner of the property which is the subject of this project and the project applicant if different from the property owner, and each of their heirs, successors and assigns, shall defend, indemnify and hold harmless the City of Huntington Beach and its agents, officers, and employees from any claim, action or proceedings, liability cost, including attorney's fees and costs against the City or its agents, officers or employees, to attack, set aside, void or annul any approval of the City, including but not limited to any approval granted by the City Council, Planning Commission, or Design Review Board concerning this project. The City shall promptly notify the applicant of any claim, action or proceeding and should cooperate fully in the defense thereof. INFORMATION ON SPECIFIC CODE REQUIREMENTS: 1. Administrative Permit No. 04-13 shall not become effective until the ten-calendar day appeal period has elapsed. 2. Administrative Permit No. 04-13 shall become null and void unless exercised within one year of the date of final approval or such extension of time as may be granted by the Director pursuant to a written request submitted to the Department of Planning a minimum 30 days prior to the expiration date. 3. The Department of Planning reserves the right to revoke Administrative Permit No. 04-13, pursuant to a public hearing for revocation, if any violation of these conditions or the Huntington Beach Zon- ing and Subdivision Ordinance or Municipal Code occurs. 4. The use shall comply with all applicable provisions of the Municipal Code, Building Department and Fire Department as well as applicable local, State and Federal Fire Codes, Ordinances and stan- dards, except as noted herein.
