NOTICE OF FILING STATUS
Application : Administration Approval No. 04-13 (Bigley /Foxcroft Residence)
Applicant: Bunnie Foxcroft, 619 Geneva Avenue, Huntington Beach, CA 92648
Request: Waiver of Development Standard to construct a new 2-car garage with a
reduced interior depth of 18'-4 in lieu of the minimum 19' or a reduced
rear yard setback of 4'-43/4" in lieu of the required 5'rear yard setback.

NOTICE IS HEREBY GIVEN that the Planning Department has reviewed your entitlement
application and has determined that the following information is necessary to continue the
review process of your application:
APPLICATION RE UIREMENTS
1. Provide three copies of a reduced site plan, 1/8" scale. The site plan shall include
dimensioned property lines, alley and at minimum the rear yard setback for the adjacent
property across the alley.
2. Provide photos of the alley, back of the subject property and back of the adjacent
property. Photos are requested to obtain further clarification to the 25' back-up radius.
STAFF CONCERNS/ISSUES
1. All building permit records indicate the property development is a single-family
residence. However, the site plan submitted indicates a single-family residence along
with an existing apartment; therefore, the property is developed as multi-family
residential. Based on the current zoning and the lot size, the property can only
accommodate one single -family residence . Provide evidence that the existing
apartment was constructed with permits and is a legal second unit. Upon
determination of the legality of the apartment, additional issues may arise.
2. The required backup distance out of the garage is 25 feet. The 25-foot backup distance is
measured from the garage door to the adjacent property line. Therefore, based on your

design, there will only be 22t/2 feet (15' alley + 2'/2' dedication + 5' setback). One of the
following alternatives must be completed prior to issuance of building permits:
a. Increase the rear yard setback to 7'/z feet.
b. Provide a letter of authorization from the adjacent property owners that 2'/2'
may be encroached on. A covenant shall be recorded on the adjacent
properties granting authorization. The covenant shall be removed upon alley
dedications of the adjacent properties. If authorization is granted, no
obstructions shall exist on adjacent properties, i.e. trees, block walls, fences,
and utility poles.
c. Obtain authorization from adjacent property owners to dedicate 2%2' at the rear
of their properties.
Please submit the above-noted information as soon as possible in order for the Planning
Department to continue the review process of your request. Please note, additional comments
and concerns may be generated upon receipt of the requested information. In addition,
completion of the corrections and/or the submittal of the additional information does not
presume approval of the application requested.
