Included in this letter are the Conditions of Ap- proval for this application. You must submit this notice of action letter to the Building Department upon requests for Certificate of Occupancy or Building Permit. Under the provisions of the Huntington Beach Zoning and Subdivision Ordinance, the action taken by the Planning Department becomes final at the expiration of the ten-day appeal period. A person desiring to appeal the decision shall file a written notice of appeal to the Secretary of the Planning Commission within ten calendar days of the date of the Planning Department's action. The notice of appeal shall include the name and address of the appellant, the decision being appealed, and the grounds for the appeal. A filing fee shall also accompany the notice of appeal. The site plan and floor plan received and dated August 19, 2003, shall be the conceptually ap- proved layout with the following modifications: a. The colors, material, and design of all features of the outdoor dining area (i.e. tables, chairs, umbrellas, etc.) shall be compatible with the exterior color scheme of the build- ing. b. The outdoor dining area shall only be located along the frontage of the restaurant unit and shall not encroach into the frontage of any other tenant suite. c. The outdoor dining deck shall not encroach into any parking space. (Code Require- ment) 2. The outdoor dining use shall comply with the following: a. All features of the outdoor dining area (i.e. tables, chairs, umbrellas, etc.) shall remain within the designated outdoor, dining area and shall not encroach into the walkway ad- jacent to the tenant suites. b. All features of the outdoor dining area (i.e. tables, chairs, umbrellas, etc.) shall be maintained in a neat and clean manner and shall be removed after business hours. c. Hours of operation of the outdoor dining area shall be consistent with those of the res- taurant. d. No signage shall be permitted in the outdoor dining area. 3. There shall be no sales to motorists or persons in vehicles. 7. The Planning Director ensures that all conditions of approval herein are complied with. The Planning Director shall be notified in writing if any changes to the site plan or floor plan are proposed. 8. The applicant and/or applicant's representative shall be responsible for ensuring the accuracy of all plans and information submitted to the City for review and approval. INFORMATION ON SPECIFIC CODE RE UIREMENTS: 1. Limited Notification No. 03-10 shall not become effective until the ten-calendar day appeal period has elapsed. Limited Notification No. 03-10 shall become null and void unless exercised within one year of the date of final approval or such extension of time as may be granted by the Director pur- suant to a written request submitted to the Planning Department a minimum 30 days prior to the expiration date. 3. The Planning Department reserves the right to revoke Limited Notification No. 03-10, pursu- ant to a public hearing for revocation, if any violation of these conditions or the Huntington Beach Zoning and Subdivision Ordinance or Municipal Code occurs. 4. The development shall comply with all applicable provisions of the Municipal Code, Build- ing Department, and Fire Department as well as applicable local, State and Federal Fire Codes, Ordinances, and standards, except as noted herein. 5.
