The comments provided in this letter reflect Planning Department review only and are limited to the information provided with the application submittal. Additional issues, which may be of concern to other departments, are not addressed as a part of this application. We encourage you to contact the Code enforcement Division and Building and Safety Department for additional information if necessary. Please note that additional issues may be identified following submittal of complete plans and/or application for entitlements The following is provided for your information: 1 ZONING. The project site consists of two parcels located within the RMH (Medium Density Residential) district. The property is also designated as RMH- 25-d (Residential Medium Density - 25 units per acre - Design Overlay) on the General Plan. Multi-family developments are permitted in the RMH district at a density of 1,742 sq. ft. of lot area per unit rA Mr Hekmat/ IPZR 03-10 7/l/2003 Page 2 of 3 2 OCCUPANCY. Building Department records indicate that the site is developed with seven (7) residential units Occupancy records for the eighth unit, designated as "Unit F," are not available 3 DENSITY. The subject site is approximately 9,330 sq ft in size Based on the maximum density of one unit for every 1,742 sq. ft of lot area, five (5) units are permitted on the site The site is currently developed with seven (7) residential units and one (1) non-permitted unit 4 NONCONFORMING USE. The existing seven-unit apartment complex is a legally nonconforming use in that it does not comply with the current density requirements established by the underlying zone Per Section 236 06 of Huntington Beach Zoning and Subdivision Ordinance (HBZSO), a structure for a nonconforming use shall not be enlarged or altered on the exterior in any manner unless- a All aspects of the existing structure and the proposed addition are made to conform to applicable provisions of this Code, or b The Zoning Administrator permits such alteration subject to approval of a conditional use permit (CUP) with the following findings 1) That the alteration is necessary to secure added safety or reduce the fire hazard or to improve the aesthetic appearance of the structure's architecture by bringing the design into greater conformance with the surrounding neighborhood 2) That the alteration or addition will not increase the number of stories. 3) That the alterations will not cause the floor area to exceed more than ten (10%) percent of the floor area the structure contained at the time the use became nonconforming The eighth non-permitted unit may not be legalized in that the density requirements of the underlying zone permit only five (5) units on the site The existing seven (7) permitted units may be altered subject to the aforementioned requirements. 5 ENTITLEMENT PROCESSING. To alter the existing seven (7) unit apartment complex without adding to the number of units, an application for a CUP is required The filing fee for a CUP for review by Zoning Administrator is $1,170 A complete application along with all submittal requirements is iequired at the time of submittal Contact the Code Enforcement Division at (714) 375-5155 for a timeline of to comply with the HBZSO. A portable metal storage also located on westside of Ac' property. The site is essentially flat. The subject structures were built in the late-?920s w ;tls•pitthed composition shingle roof, wood siding exterior, and the two - story buAojjgs fouild8d' on continuous perimeter and interior concrete stem walls and isolated pier post.s.and footing, and the single - story structures have concrete slab on grad foundation system. *see 24357 Norttmew Suite # 1 Diamond Bar, CA. 91765 Telephone (909) 323- 4487 Facsimile (909) 861- 0978 Mr. John Rapsomanikis ,Property Owner • June, 2003 Pro osal or Le all in Unit F o Lake Street A artments Pa e 2 In addition to the two - car garage, another four open parking spaces are located on west end of the property (Photo No. 5). 3.0 PROPOSE ADDITION AND UPGRADE FOR UNIT F According to the owner information, and the property profile document by Orange Coast Title Company dated Jun 24, 1992, and some other available documents this property included of eight apartment units, but either a certification of occupancy was not issued for this unit, or not any record of such occupancy certificate is presently available . Furthermore per available drawing, and some of the building permits that have been signed off by Building Department, unit F on west end of the property was originally a one - bedroom apartment, and this bedroom was conve rted to a two - car garage for additional parking. The City of Huntington Beach code enforcement claim that bedroom conversion was done without proper building permit, and to get a certification of occupancy for this unit it shell legalize , and finalize by building department. A+ engineers visit the site, and inspected unit F for structural safety, and compli ance to the latest addition of the Uniform Building Code. Since condition of unit F was structurally inadequate, we recommended expose the interior walls , and the ceiling framing for inspection . Stripping of the interior walls , and the ceiling were done by a permit, and inspection from City of Huntington Beach building department. On the basis of finding in our second site inspection, the following results and recommendations are presented in this report. A+ engineering is of the opinion that present condition of unit F do not comply with Uniform Building Code, neither structurally safe for human occupancy. Furthermore, since City of Huntington Beach required additional parking space for the subject site, and portion of Unit F area (Bedroom) was converted to a garage for additional parking spaces for the tenants. The remaining area of unit F is less then a minimum 220 sq. ft. living area that require by the Uniform Building Code section 310.7 for efficiency dwelling unit. The findings, conclusions, and recommendations presented in this report address observed site condition only, and do not address code compliance, possible future hazard, and non-structural issues such as fire safety, asbestos mitigation, and etc. Identification and evaluation of potential structural seismic deficiencies is beyond the scope of this evaluation. Any discussion of such deficiencies in this report should not be considered exhaustive, and any repairs to correct deficiencies noted in this report should be develop by qualified engineer hired for that specific purpose. The conclusions and professional opinions presented in this report were developed by A+ Engineering, Inc. in accordance with generally accepted engineering principles and practice.
