WAIVER)

REQUEST: To permit the construction of a second story addition at the same side yard set-
back as the existing one-story residence, which has a legal non-conforming side
yard setback of 3 feet 11 inches in lieu of the required setback of 4 feet 4 inches
(10% reduction).

Dear Mr. Mehalick,
The Planning Department reviewed and approved your request on October 3, 2003 for a Waiver
of Development Standards in accordance with Section 241.22 of the Huntington Beach Zoning
and Subdivision Ordinance (HBZSO). Attached to this letter are the findings and conditions of
approval for your application. You must submit this notice of action letter to the Planning and
Building & Safety Departments upon request for a Building Permit.
Under the provisions of the Huntington Beach Zoning and Subdivision Ordinance, the action
taken by the Planning Department becomes final at the expiration of the ten-day appeal period.
A person desiring to appeal the decision shall file a written notice of appeal to the Secretary of
the Planning Commission within ten calendar days of the date of the Planning Department's ac-
tion. The notice of appeal shall include the name and address of the appellant, the decision being
appealed, and the grounds for the appeal. A filing fee shall also accompany the notice of appeal.
The appeal fee is $255 for a single-family dwelling property owner appealing the decision on
his/her own property. The appeal fee is $865 for all other appeals.

FINDINGS OF APPROVAL/DENIAL -
ADMINISTRATIVE APPROVAL NO. 03-04
FINDINGS FOR PROJECTS EXEMPT FROM CE A:
The Department of Planning finds that the project will not have any signific ant effect on the en-
vironment and is exempt from the provisions of the California Environmental Quality Act
(CEQA) pursuant to Section 15305 of the CEQA Guidelines because the project consists of a
minor alteration in land use limitations which will not result in any changes in land use or den-
sity.
FINDINGS FOR APPROVAL:
1. The proposed construction of a second story addition at the same side yard setback as the ex-
isting one-story residence, which has a legal non-conforming side yard setback of three feet
eleven inches, does not exceed ten percent deviation from the four foot four inch (10 percent
of lot width) required setback in the RMH-A (Residential Medium High Density - Small Lot
Overlay) base zoning district.
2. The requested waiver improves the design of the project by avoiding a five inch offset be-
tween the existing first story and proposed second story which would result in an awkward
facade design. The proposed design utilizes high quality building materials, architectural in-
terest by the use of the sloped roof and porch entry design, while ensuring no detrimental im-
pacts to surrounding properties.
3. Notwithstanding the request for a five-inch reduction in the side yard setback, the proposed
second story addition does not require approval of any discretionary permits, and will not in
any way degrade the environment or result in any changes to land use. With the exception of
the proposed three foot eleven inch side yard setback, the proposed addition conforms to all
applicable development standards, including maximum lot coverage, maximum height, and
minimum separation between structures.
CONDITIONS OF APPROVAL - ADMINISTRATIVE APPROVAL NO. 03-04:
1. The site plan, floor plan and elevations received and dated September 15, 2003, shall be the
conceptually approved layout.
2. The applicant and/or applicant's representative shall be responsible for ensuring the accuracy
of all plans and information submitted to the City for review and approval.
INFORMATION ON SPECIFIC CODE RE UIRE MENTS:
1. Administrative Approval No. 03-04 shall not become effective until the ten calendar day
appeal period has elapsed.
2. The use shall comply with all applicable provisions of the Municipal Code, Building Divi-
sion, and Fire Department as well as applicable local, State and Federal Fire Codes, Ordi-
nances, and standards, except as noted herein.
