Pursuant to Section 241.24 of the Huntington Beach Zoning and Subdivision Ordinance, the Neighborhood Notification process is required. You may review the proposed plans at the Planning Department, 2000 Main Street, Huntington Beach, CA, from March 20, 2009 to April 2, 2009 (Minimum 10 days), or contact the Planning Department at (714) 536-5271. All comments must be submitted to the Planning Department prior to the expiration date for review of the proposal. Under the provisions of the Huntington Beach Zoning and Subdivision Ordinance, the action taken by the Director of Planning becomes final, unless appealed. A person desiring to appeal the decision shall file a written notice of appeal with the Planning Department within ten calendar days of the date of the Planning Department's action. The notice of appeal shall include the name and address of the appellant, the decision being appealed, and the basis for the appeal. A filing fee shall also accompany the notice of appeal. The appeal fee is $1,287.00 for a single-family dwelling property owner appealing the decision on his/her own property. The appeal fee is $494.00 for all other appeals. WHEREAS, Declarant is the owner of the real property located at 608 Jana Circle in the City of Huntington Beach (hereinafter referred to as the "Subject Property") more particularly described as Lot 7 Tract 3950 in the City of Huntington Beach, County of Orange, State of California; and Declarant has applied to the City of Huntington Beach (hereinafter referred to as the "City") for permission to construct a 646 square foot accessory dwelling unit in conjunction with a existing single family residence on the Subject Property; and Declarant desires to establish certain covenants, conditions and restrictions which shall run with the Subject Property for the purpose of enhancing and protecting the value, desirability and attractiveness of the Subject Property. NOW THEREFORE, Declarant does hereby certify, agree and declare that the Subject Property, and each portion thereof, shall be held, used, leased, sold, and conveyed subject to each and all of the covenants, conditions and restrictions contained herein, each and all of which are hereby declared to be for the benefit of all the Subject Property and each portion thereof, and each present and future owner thereof, and Declarant. That these covenants, conditions and restrictions shall run with the Subject Property in perpetuity, and shall be binding upon the undersigned Declarant owner, his heirs, successors, and assigns, and any future owners of the Subject Property and their heirs, successors and assigns, unless otherwise released by written instrument approved and authorized by the City.
