Your application was acted upon by the Planning Department of the City of Huntington Beach
on November 19, 2003, and your request was Denied. Included in this letter are the Conditions
of Approval for this application. You must submit this notice of action letter to the Building De-
partment upon requests for Certificate of Occupancy or Building Permit.
Under the provisions of the Huntington Beach Zoning and Subdivision Ordinance, the action
taken by the Planning Department becomes final at the expiration of the ten-day appeal period.
A person desiring to appeal the decision shall file a written notice of appeal to the Secretary of
the Planning Commission within ten calendar days of the date of the Planning Department's ac-
tion. The notice of appeal shall include the name and address of the appellant, the decision being
appealed, and the grounds for the appeal. A filing fee shall also accompany the notice of appeal.
The appeal fee is $409.00 for a single-family dwelling property owner appealing the decision on
his/her own property. The appeal fee is $1,063.00 for all other appeals.

FINDINGS FOR DENIAL - LIMITED NOTIFICATION NO. 03-14
1. Limited Notification No. 03- 14 for the establishment, maintenance and operation of a home
occupation consisting computer related instruction for 4 students at any given time will be
detrimental to the general welfare of persons working or residing in the vicinity or detrimen-
tal to the value of the property and improvements in the neighborhood. The proposed home
occupation will impact off-site parking within the residential neighborhood. The existing
.single family home is required to provide 4 parking (2 enclosed) spaces for the residents of
the dwelling. Five parking spaces (2 enclosed) are provided on the site. Only one parking
space is provided on site to accommodate the proposed home occupation, which may result
in the need for three off-site parking spaces on Indigo circle. The surrounding residential
neighborhood will be negatively impacted by the increase in parking demand.
2. The conditional use permit will not be compatible with surrounding residential uses because
the proposed home occupation will consists of up to four students at a time which may result
in increase traffic and parking along Indigo Circle.
3. The granting of the conditional use permit will not adversely affect the General Plan. It is
consistent with the Land Use Element designation of Residential Low Density on the subject
property. In addition, it is consistent with the following objective of the General Plan:
LU 9.2: Provide for the preservation of existing residential neighborhoods
The proposed home occupation will increase traffic and parking demands on Indigo Circle,
which may result in a negative impact to the existing residential neighborhood.
