PETITION DOCUMENT: ADMINISTRATIVE PERMIT NO. 05-04 (Bitting Residence)

PROPERTY OWNER: Kenneth Bitting, 228 9th St., Huntington Beach, CA 92648
REQUEST: To permit a waiver of development standards pursuant to Section 241.22 in
conjunction with a 59 sq. ft. second story addition to an existing single fam-
ily home. The waiver of development standards is a request to permit a lot
coverage of 55% in lieu of the maximum allowed lot coverage of 50% to al-
low extension of a second story office.

Dear Mr. Roa:
The Planning Department of the City of Huntington Beach denied your request to exceed the 50 percent
maximum lot coverage requirement on March 29, 2005, for a Waiver of Development Standards. At-
tached to this letter are the findings for denial on your application.
Under the provisions of the Huntington Beach Zoning and Subdivision Ordinance, the action taken by the
Department of Planning is final unless an appeal is filed to the Planning Commission by you or by an in-
terested party. A person desiring to appeal the decision shall file a written notice of appeal to the Secre-
tary of the Planning Commission within ten calendar days of the date of the Planning Department's action.
The notice of appeal shall include the name and address of the appellant, the decision being appealed,
and the grounds for the appeal. A filing fee shall also accompany the notice of appeal. The appeal fee is
$485 for a single-family dwelling property owner appealing the decision on his/her own property. The
appeal fee is $1,540 for all other appeals. Said appeal must be in writing and must set forth in detail the
action and grounds by which the applicant or interested party deems himself aggrieved. The last day for
filing an appeal and paying the filing fee for the above noted application is April 8, 2005.

FINDINGS FOR DENIAL:
1. The proposed lot coverage of 55 percent resulting from the construction of a 59 square foot second
story addition to an existing single family home does not directly improve the design of the project.
2. No special circumstances are applicable to the subject property, including size, shape, topography and
location. Strict application of the zoning and subdivision ordinance does not deprive the subject prop-
erty of privileges enjoyed by other properties in the vicinity and under identical zone classification.
