Included in this letter are the Conditions of Approval for this application. Under the provisions of the Huntington Beach Zoning and Subdivision Ordinance, the action taken by the Zoning Administrator is final unless an appeal is filed to the PI nning Commission by you or by an interested party. Said appeal must be in writing and mur'. set forth in detail the action and grounds by which the applicant or interested party deems himself aggrieved. Said appeal must be accompanied by a filing tee of Two Hundred Dollars ($200.00) if the appeal is filed by a single family dwelling property owner appealing the decision on his own property and Six Hundred Ninety Dollars ($690.00) if the appeal is filed by any other party. The appeal shall be submitted to the Secretary of the Planning Commission within ten (10) calendar days of the date of the Zoning Administrator's action. The last day for filing an appeal and paying the filing fee for the above noted application is November 1, 1999. Provisions of the Huntington Beach Zoning and Subdivision Ordinance are such that any application becomes null and void one (I) year after the final approval, unless actual construction has begun. -oft k Conditional Use Permit No. 99-47 Page No. 2 FINDINGS FOR PROJECTS EXEMPT FROM CE( A: The Zoning Administrator finds that the project will not have any significant effect on the environment and is exempt from the provisions of the California Environmental Quality Act (CEQA ) pursuant to section 15301 of the C:EQA Guidelines, because the project is considered a minor am-ration of an existing facility. FINDINGS FOR APPROVAL - CONDITIONAL USE PERMIT NO. 99-47: 1. Conditional Use Permit No. 99-47 for the establishment, maintem.nce and operation of the wireless telecommunication facility consisting of one 55-foot monopole antenna in lieu of a 50-foot maximum height will not be detrimental to the general welfare of persons working or residing in the vicinity or detrimental to the value of the property and improvements in t' neighborhood . The antenna will resemble a palm tree, which will disguise the monopo e and minimize visual impacts from adjacent properties. The wireless telecommunication facility will not generate noise or other impacts, which would be detrimental to surrounding commercial and residential uses. 2. The conditional use permit will be compatible with surrounding comi:,ercial and residential uses . The proposed antenna will be locatca in the rear of the commercial center, which will minimize visual impacts from adjacent commercial properties . The proposed antenna will also be disguised as a palm tree to minimize vi-- :,I impacts to adjacent residential properties. 3. The proposed conditional use permit will comply with the provisions of the base district and other applicable provisions in Titles 20-25 of the Huntington Beach Zoning and Subdivision Ordinance and any specific condition required for the proposed use in the district in which it would be located. The HBZSO allows wireless telecommunications facilities to exceed the maximum height limit by a conditional use permit. 4. The granting of the conditional use permit will not adversely affect the General Plan. It is consistent with the Land Use Element designation of Commercial General on the subject property. CONDITIONS OF APPROVAL- CONDITIONAL USE PERMIT NO. 99-47: 1. The site plan, floor plans and elevations received and dated September 27, 1999 shall be the conceptuaily approved layout with the following modifications: a The height of the monopole will be reduced to 55 feet. q.. Conditional Use Permit No. 99-47 Page No. 3 b. Two adjacent parking spaces will be removed and will be designed as a planter. c. Two 30-40 foot high palm trees will be planted adjacent to the monopole in the new planter. 2. Prior to submittal for building permits, the following shall be comoletcd: a. Zoning entitlement conditions of approval shall be printed verbatim on the cover page of all the working drawing sets used for issuance of building permits (architectural, structural, electrical, mechanical and plumbing). b. Submit copy ofthe revised site plan, floor plans and elevations pursuant to Condition No. I for review and approval and inclusion in the entitlement file to the Department of Planning. 3. Prior to issuance of building permits, the following shall be completed: a. A Landscape Construction Set must be submitted to the Department of Public Works and approved by the Departments of Public Works and Planning. The Landscape Construction Set shall include a landscape plan prepared and signed by a State Licensed Landscape Architect which identifies the location, type, size and quantity of all existing plant materials to remain, existing plant materials to be removed and proposed plant materials; an irrigation plan; a grading plan; an approved site plan and a copy of the entitlement conditions of approval.' 4. Prior to final building permit inspection and approval, the following shall be completed: a. The parking lot shall be restriped to reflect restriping plan detailed in approved Initia! Planning and Zoning Review 9-8-2.- b. All building spoils, such as unusable lumber, wire, pipe, and other surplus or unusable material, shall be disposed of at an off-site facility equipped to handle them. 5. The Planning Director ensures that all conditions of approval herein are complied with. The Planning Director shall be notified in writing if any changes to the site plan, elevations and floor plans are proposed as a result of the plan check process. Building permits shall not be issued until the Planning Director has reviewed and approved the proposed changes for conformance with the intent of the Zoning Administrator's action and the conditions herein. DATE: SUBJECT: Planning Commission Howard Zelefsky, Planning Director Lisa Mercurio, Planner November 26, 1996 CONDITIONAL USE PERMIT NO. 96-77 (Fitzgerald 's Sport Pub) LOCATION: 19171 Magnolia Street (Magnolia Center - south of K-Mart at the southwest corner of Magnolia St. & Garfield Avenue) Conditional Use Permit No. 96-77 represents a request to have live amplified entertainment, dancing and three (3) pool tables in conjunction with an existing restaurant. The applicant would like to provide musical groups and dancing to local residents and tourists and believes this expansion to the restaurant will attract more patrons. This site is located in a commercial area, and to the north is the K-Mart center. The closest residential area is over 200 feet away. The noise level of the live amplified entertainment and dancing proposed will not increase the sound kvcl outside the building due to the sound system. Adequate parking is available in the center. Staff recommends the Planning Commission approve Conditional Use Permit No. 96-77 for the following reasons: • The request is to an existing restaurant that is adjacent to commercial property and separated from residential properties by an Edison right-of-way and commercial building. • The request will not be detrimental to surrounding land uses and will be compatible with adjoining commercial uses. • The noise level of the proposed entertainment will be controlled through a sound system. • The Police Department has not received any complaints from this sits during the last year. • The request complies with the Zoning and Subdivision Ordinance and parking requirements. • The proposed change complies with the provisions of the General Plan. ' !III II 11 I!3s7 :iff. ._ l 7 ;The'Departments of Public Works, Fire, Economic Development, and Community Services have no :concerns. The Departments of the Building Division has expressed exiting concerns which will be resolved prior to issuance of building permits for tenant improvements. The Police Department has reviewed an Entertainment Permit and conditionally approved it with seven (7) conditions (Attachment No. 6). The conditions state that the hours of live entertainment (shall be limited to between 8:00 PM .and .1:30 AM) and no more than four live entertainment members are permitted; dancing and an admission charge is allowed; a cover charge is not allowed; a clearly identifiable security guard on duty during times of actual live entertainment is required; and that live entertainment sound shall be contained within the building. On November 14, 1996, Conditional Use Permit No. 96-77 was published in the Huntington Beach- -Fountain Valley Independent. Notices were mailed to all property owners within 300 feet of the subject property (Magnolia Center) and to all tenants within the Magnolia Center. ANALYSIS: The proposed interior change to the existing use is compatible with the existing and surrounding land uses. The restaurmt/sport's pub is located in the center of the Magnolia Center in a commercial zone. To the north is the K-Mart retail/commercial center. The applicant's suite faces the K-Mart center, and the rear faces the 230 foot Edison right-of-way to the south. The nearest residential areas are over 200 feet away from the suite. Parking: The proposed dance floor expansion to the existing restaurant does comply with the City's parking requirements. The shopping center has 209 parking spaces available on-site; 204 parking spaces are currently required based upon the mix of uses in the center and Conditional Use Permit No. 96-12 that was approved for a dance studio in May, 1996. The proposed dance floor will increase the center's overall parking requirement by two spaces to a total of 206 spaces as follows: Staff Report - 11/26/96 S (pesr230) USE - Existing restaurant Existing restaurant w/proposed dance floor TOTAL Existing Retail Center (includes 204 209 2,820 sq. ft. restaurant) Existing Retail Center with 206 209 restaurant and proposed 175 sq. ft. dance floor Flours of operation for the other businesses in the center also reduce any potential parking conflicts. Nine of the 17 retail spaces in the center close at 5:00 p.m.. and two other businesses in the center close at 7:00 p.m.. The remaining five businesses (excluding Fitzgerald's) close between 8:00 p.m. - 11:00 p.m.. The applicants proposal to allow the live entertainment to start at 8:00 p.m. will not attract people in until most of the businesses have closed for the evening. Magnolia Center also has access to the K-Mart center to the north if the necessity arises for additional parking spaces. The restaurant/sport's pub is located over 200 feet away from any residential uses. The noise level of the entertainment will be regulated through a sound system that will control the level of output to the speakers. Condition I of the Department of Alcoholic Beverage Control license states that the noise level must be controlled per their standards, and must not be audible beyond the control of the licensee(s). Condition 2 of this license also states that the rear door(s) must be kept closed at all times during the operation of the premises except in cases of emergency and to permit delivers. Potential sources of noise conflict will be thoroughly addressed in the Conditions of Approval that will follow this Conditional Use Permit.
