second floor addition to an existing single-family home.

Dear Mr. Francis:
The Planning Department of the City of Huntington Beach reviewed your request to deviate from the
minimum required side yard setback of five (5) feet by six (6) inches in accordance with Section 241.22
of the Huntington Beach Zoning and Subdivision Ordinance. The Planning Department approved your
request on February 24, 2004, for a Waiver of Development Standards. Attached to this letter are the find-
ings and recommended conditions of approval for your application. You must submit this notice of action
letter to the Planning and Building & Safety Departments upon request for a Certificate of Occupancy
and/or Building Permit.
Under the provisions of the Huntington Beach Zoning and Subdivision Ordinance, the action taken by the
Department of Planning is final unless an appeal is filed to the Planning Commission by you or by an in-
terested party. Said appeal must be in writing and must set forth in detail the action and grounds by which
the applicant or interested party deems himself aggrieved. Said appeal must be accompanied by a filing
fee of Four Hundred Eighty Five dollars ($485.00). The appeal shall be submitted to the Secretary of the
Planning Commission within ten (10) calendar days of the date of the Department of Planning's action.
The last day for filing an appeal and paying the filing fee for the above noted application is March 5, 2004.

FINDINGS AND CONDITIONS OF APPROVAL
ADMINISTRATIVE APPROVAL NO. 04-02
FINDINGS FOR PROJECTS EXEMPT FROM CE A:
The Department of Planning finds that the project will not have any significant effect on the environment
and is exempt from the provisions of the California Environmental Quality Act (CEQA) pursuant to Sec-
tion 15301 of the CEQA Guidelines because the project consists of a minor alteration to an existing single
family dwel ling.
FINDINGS FOR APPROVAL:
1. The proposed 4'-6" inch side yard setback does not exceed a ten percent (10%) deviation from the
minimum required 5'-0" side yard setback applicable in the RL (Residential Low Density) base zoning
district, pursuant to Section 210.06 of the Huntington Beach Zoning and Subdivision Ordinance.
2. The proposed six (6) inch projection into the required 5'-0" side yard setback improves the design of
the project by keeping the walls of the addition in line with that of the existing structure thus allowing
the addition to appear as a part of the original construction of the house. The addition is located be-
tween the two-story home and northerly side property and behind the existing garage. The northerly
side property line is at angle; therefore the six-inch projection is limited to a small portion of the addi-
tion. Compliance with the side yard setback would require that a substantial portion of the addition be
constructed at an offset from the existing structure.
3. The proposed 4'-6" inch side yard setback would not otherwise require any discretionary permits, and
will not in any way degrade the environment or result in any changes to land use. With the exception
of the proposed 4'-6" inch side yard setback and interior improvement constructed within the garage
without Building Permits, the proposed addition conforms to all applicable development standards, in-
cluding maximum height, and minimum front and side yard setbacks. A condition is placed on the
project requiring that all construction installed without permits shall require a Building Permit.
CONDITIONS OF APPROVAL - ADMINISTRATIVE APPROVAL NO. 04-02:
The site plan, floor plan and elevations received and dated February 13, 2004, shall be the conceptually
approved layout.

INDEMNIFICATION AND HOLD HARMLESS CONDITION:
The owner of the property which is the subject of this project and the project applicant if different from
the property owner, and each of their heirs, successors and assigns, shall defend, indemnify and hold
harmless the City of Huntington Beach and its agents, officers, and employees from any claim, action or
proceedings, liability cost, including attorney's fees and costs against the City or its agents, officers or em-
ployees, to attack, set aside, void or annul any approval of the City, including but not limited to any ap-
proval granted by the City Council, Planning Commission, or Design Review Board concerning this pro-
ject. The City shall promptly notify the applicant of any claim, action or proceeding and should cooperate
fully in the defense thereof.
