LOCATION: 9322 Mokihana Drive, 92646 (south of Mokihana Drive, west of Bushard Street) DATE OF ACTION: April 6, 2010 On April 6, 2010 , the Planning and Building Department of the City of Huntington Beach took action on your request and APPROVED your request with conditions. Attached to this letter are the conditions of approval for your application. Please be advised that the Department of Planning and Building reviews the conceptual plan as a basic request for entitlement of the use applied for and there may be additional requirements prior to issuance of building permits, It is recommended that you immediately pursue completion of the conditions of approval and address all requirements of the Huntington Beach Zoning and Subdivision Ordinance in order to expedite the processing/completion of your project. The conceptual plan should not be construed as a precise plan, reflecting conformance to all Zoning and Subdivision Ordinance requirements. Under the provisions of the Huntington Beach Zoning and Subdivision Ordinance, the action taken by the Department of Planning is final unless an appeal is filed to the Planning Commission by you or by an interested party. A person desiring to appeal the decision shall file a written notice of appeal to the Secretary of the Planning Commission within ten calendar days J Administrative Permit No. 10-002 April 6, 2010 Page 2 of 2 of the date of the Planning and Building Department's action. The notice of appeal shall include the name and address of the appellant, the decision being appealed, and the grounds for the appeal. A filing fee of $494 shall also accompany the notice of appeal. Said appeal must be in writing and must set forth in detail the action and grounds by which the applicant or interested party deems himself aggrieved. The site plan and floor plan received and dated February 19, 2010, shall be the conceptually approved layout. 2. The home occupation use shall comply with the following: a. Dance instruction shall be limited to a maximum number of 4 students during any class session. b. Dance instruction shall not operate between the hours of 9PM and 7AM. c. Dance instruction shall be prohibited a minimum of 15 minutes between the conclusion and commencement of each session. d. All doors and windows shall remain closed during the times of dance instruction. e. Sounds barriers shall be provided adjacent to all windows and doors within the designated dance area. f. Students shall only enter/exit from the main entrance of the dwelling facing Mokihana Drive. g. No students may be permitted to wait outside of the dwelling before and after each class session. All students shall wait within the living room area of the dwelling. h. Vehicles dropping off/picking up students shall park in a legal manner and not impede the public right-of-way. i. The home occupation shall be conducted entirely within the property. No outdoor storage shall be permitted. Required garage parking area shall not be used in connection with such use except to park business vehicles. j. No one other than a resident of the dwelling shall be employed on-site or report to work at the site in the conduct of a home occupation. This prohibition also applies to independent contractors. k. There shall be no display of merchandise, projects, operations, signs or name plates of any kind visible from outside the dwelling. The appearance of the dwelling shall not be altered, or shall the business be conducted in a manner to indicate that the dwelling or its premises is used for a non-residential purpose, whether by colors, materials, construction, lighting, windows, signs, sounds (excluding music utilized in association with dance instruction) or any other means whatsoever. 1. The home occupation shall not adversely increase pedestrian or vehicle traffic in the neighborhood. m. No commercial vehicle or equipment used in conjunction with the home occupation shall be parked overnight on an adjacent street or in any yard visible from the street. n. The home occupation shall not include an office or salesroom open to visitors, and there shall be no advertising of the address of the home occupation. To the maximum extent feasible, dance instruction classes shall be scheduled so that there are an equal number of sessions on any given day. p. Any authorized City employee may inspect the premises of a home occupation upon 48 hours notice to ascertain compliance with these conditions and any requirements of this code. The permit for a home occupation that is not operated in compliance with these provisions shall be revoked by the Director after 30 days written notice unless the home occupation is altered to. comply. INFORMATION ON SPECIFIC CODE REQUIREMENTS: 1. The applicant and/or applicant's representative shall be responsible for ensuring the accuracy of all plans and information submitted to the City for review and approval. 2. Administrative Permit No. 10-002 shall not become effective until the ten-calendar day appeal period has elapsed. 3. Administrative Permit No. 10-002 shall become null and void unless exercised within one year of the date of final approval or such extension of time as may be granted by the Director pursuant to a written request submitted to the Planning Department a minimum 30 days prior to the expiration date. 4. The Planning Department reserves the right to revoke Administrative Permit No. 10-002, pursuant to a public hearing for revocation, if any violation of these conditions or the Huntington Beach Zoning and Subdivision Ordinance or Municipal Code occurs. 5. The development shall comply with all applicable provisions of the Municipal Code, Building Department, and Fire Department as well as applicable local, State and Federal Fire Codes, Ordinances, and standards, except as noted herein.
