• We are able to park two cars in our driveway and two in front of our home so that
no neighbors are affected by parking. Most families carpool, or walk, or ride
bikes so that we do not add to traffic on the street.
• We are committed to having no noise problems for the neighbors due to tap
dancing or music. We will keep all windows and doors closed during tap
instruction and we have installed sound barriers outside all windows and doors of
the studio.
• All students will go straight from their parent's car into the home, and will be
picked up within the home. All students and parents waiting for classes will wait
inside the home.
• All entry for business will be made through the front door so there will be no
noise for neighbors on the side entrances of the home.
• No children will be outside unattended during class instruction.
• All classes will comply with the mandate of 4 students per class.
• After May 22°d, the structure of the classes will be adjusted to reflect a more
balanced schedule across multiple days.

keep the music volume low during any time doors and windows are open. We also put
up sound barriers outside the windows to keep sound from traveling.
We are not currently planning any expansion of hours. We will not give classes during
evening hours.

My neighbor at 9322 Mokihana has applied for a permit to operate a dance instruction in their
home. This activity has already been going on for more than a year. Despite their application for a
dance instruction permit, they did not indicate that they teach TAP DANCING in their home. They
have installed a raised wood dance floor in the Family Room, with a large door wall that opens
directly into the back of our home. Their loud music and incessant tap dancing has made it
impossible for us to use our patio or keep our door wall open all last summer.
Scott, I am the construction manager for the recent Seismic Upgrade at City Hall. Can you imagine
having that recent pounding going on all day, every day, outside your home.
Please do not grant a tap dance instruction permit to 9322 Mokihana.

My home backs up to the Hernandez property on the S/W corner of the rear of their
property.
For quite some time I have been tolerating the noise from their home from tap dancing
and very loud music. I was under the impression that it was a hobby or something of that
nature. On several occasions I have had to call out over the fence to keep the noise down
and ask for the tap dancing to stop.
The general proximity of my home to their studio is such that my family room, office and
master bedroom are at the rear of my property therefore very close to where the noise
comes from. In many cases in the past I have been unable to leave the doors and windows
open during their sessions due to the intense noise created by several people tap dancing
at the same time not to mention the drone of the music that accompanies the dancing.
With my office door open I am unable to carry on a phone conversation when they are in
session. I have been unable at times to enjoy the rear patio area of my home as well. On
one occasion I was woken from a deep sleep at 8:00 AM on a Saturday morning due to
several people tap dancing at the same time in their studio.
As you must understand a legal or licensed dance studio in a residential neighborhood
will cause a noise nuisance to many of the surrounding properties.
As a landowner I am entitled to the covenant of Quiet Enjoyment, which is the right to
the use of my premises in peace and quiet without interference.
Disturbance of quiet enjoyment by another can be a nuisance for which a lawsuit can be
brought to halt the interference.
Additionally as a Realtor I know that any noise nuisance must be disclosed to a potential
buyer of my property and could adversely affect the value of my property.

My husband and I (Larry and Pat Szatkowski) are responding to the lett er dated 2/18/10 by Tony and
Christy Hernandez who are planning a dance studio in their home. They currently have plans with the
Planning Department of Huntington Beach.
We live directly behind the Hernandez's at 9321 Hudson Dr., Huntington Beach. We have been
residents of Huntington Beach over 27 years. We love our home and the neighborhood because of the
peace and quiet.
The Hernandez's have been using their home as a dance studio doing Tap dancing and Hip Hop for the
ast ear and half. The back of our house to their family room is approximately 50 ft. The noise from
the music and the TAP dancing is very loud and it vibrates though our home. We have closed our doors
and windows but we still hear the noise through our home. We can no longer sit outside and enjoy our
backyard because the loud TAPPING and MUSIC. This past summer I was home and I was not able to
keep my windows and doors open because of the constant noise. I had to stay indoors because of their
business activities. THIS IS WHERE WE DRAW THE LINE. This business should not be in a residential
neighborhood. All the neighbors around us have complained about the noise. You will be hearing from
them.
A business of this kind is not compatible with the peace and quiet we are entitled to in our
neighborhood. If we were to put our house up for sale, we would be required to disclose this non-
conforming activity to any prospective buyers. This would surely affect the value and salability of our
property.
Please, do not allow this TAP dancing studio to happen.
You have long standing citizens of Huntington Beach who have been in their homes for over 30 years.
Don't let this happen to our neighborhood. Please deny their request.

To whom it may concern.
We strongly oppose the dance studio at 9322 Mokihana Drive. There have been both
parking and noise issues. What started out being a single dance class has grown to
multiple classes on multiple days. There have been as many as six to eight students and
teacher tap dancing. The noise level is both excessive and annoying. The dance studio is
located adjacent to both my family room and my master bedroom. They are now teaching
three hours of tap starting at 8:00 A.M . Saturday mornings. I have enjoyed living in this
wonderfully quiet neighborhood until recently. I feel that their pattern of adding students
and classes this situation will only get worse. I have been unable to park in front of my
house because my neighbor and their tenant have occupied the parking in order to keep
the parking in front of their house for their customers. Recently I parked in front of their
house and was verbally and physically attacked. The mothers that pick up their children
double park, park on the sidewalk, park blocking my driveway, and have even parked in
my driveway. The children waiting to he picked up or dropped off early are unsupervised.
They climb on my walls, throw things over the walls, chase my cats. These behaviors go
unchallenged. I think that this type of business is better suited to a business area where
parking and noise do not affect the quality of life we come to expect in our homes. I ask
the board to please deny their proposal and return to us the quiet neighborhood we've
enjoyed for many years.
