SUBJECT: ADMINISTRATIVE APPROVAL NO. 03-05 GRIMES GARAGE

REQUEST: To permit the construction of a 308 s.f. side entry third car garage at a front
setback of nine (9) feet in lieu of the required front setback of ten (10) feet.

Dear Mr. Grimes,
The Planning Department reviewed and denied your request on November 24, 2003 for a
Waiver of Development Standards in accordance with Section 241.22 of the Huntington Beach
Zoning and Subdivision Ordinance (HBZSO). Attached to this letter is the finding for denial for
your application.
Under the provisions of the Huntington Beach Zoning and Subdivision Ordinance, the action
taken by the Planning Department becomes final at the expiration of the ten-day appeal period.
A person desiring to appeal the decision shall file a written notice of appeal to the Secretary of
the Planning Commission within ten calendar days of the date of the Planning Department's ac-
tion. The notice of appeal shall include the name and address of the appellant, the decision being
appealed, and the grounds for the appeal. A filing fee shall also accompany the notice of appeal.
The appeal fee is $485 for a single-family dwelling property owner appealing the decision on
his/her own property. The appeal fee is $1,540 for all other appeals.

FINDING FOR DENIAL
ADMINISTRATIVE APPROVAL NO. 03-05
The proposed nine (9) foot front setback for a 308 s.f. side entry third car garage in lieu of the
required front setback of ten (10) feet does not improve the design of the project. The reduced
setback is not needed to provide a garage that complies with code. The proposed garage is over-
sized and can be redesigned to comply with the minimum front yard setback while still allowing
for a garage that meets the required minimum dimensions.
