Dear Mr. Vovos:
Subject: Permit # B091216 for work at 4002 Ondine Circle - Limited Stop Work Order
It has come to our attention that there exists discrepancies between the approved plans and the
field conditions for the work authorized by the referenced permit. Specifically the following
areas of concern need to be addressed:
1. The extension to the living room at the rear of the property is constructed too close to the rear
property line and bulkhead. The approved site plan indicates that the addition would be
constructed to provide a minimum ten-foot setback to the property line. As constructed, it
appears that the setback is approximately 4.5 feet. A survey will be necessary to determine
the actual setback constructed. This substandard setback creates two areas of concern.
First, the setback violates the zoning code required ten-foot rear setback. A zone variance
could be requested, although there is no guarantee that the variance will be granted.
Information on that process is available from the Planning Department
Secondly, the location of the structure places a surcharge load on the bulkhead wall. Even if a
zone variance is granted, the surcharge condition will require your engineer to design112
additional depth footings. I am including our department policy on bulkhead surcharge
loading for your review and use with your engineer
Until this issue is resolved , you are directed to stop work on this portion of the project.
2 The room titled "existing closet" on the third floor indicated as 7 ft. by 11 ft., was not a part
of the third floor addition (bonus room) to the structure permitted in 1995 This area will
need to be permitted with plans and supporting documentation The "bonus room" meets the
definition of a sleeping area and must be equipped with an emergency egress window
complying with the building code. The approved plans for the "bonus room" in 1995
indicated an emergency egress window was to be installed
City staff will be available to meet with you or you representative to review the issues and
potential solutions . If you desire such a meeting , please contact me at (714) 536-5677 and I will
