To deviate from the minimum 15 foot front yard setback by one foot - six inches on the southwest corner of the property in order to construct a 700 square foot single story addition to an existing single family residence. The Planning Department of the City of Huntington Beach reviewed and denied your request to deviate from the minimum 15-foot front yard setback by one foot - six inches in accordance with Section 241.22 of the Huntington Beach Zoning and Subdivision Ordinance Attached to this letter is the finding for de- nial for your application. Under the provisions of the Huntington Beach Zoning and Subdivision Ordinance, the action taken by the Planning Department becomes final at the expiration of the ten-day appeal period. A person desiring to appeal the decision shall file a written notice of appeal to the Secretary of the Planning Commission within ten calendar days of the date of the Planning Department's action. The notice of appeal shall in- clude the name and address of the appellant, the decision being appealed, and the grounds for the appeal A filing fee shall also accompany the notice of appeal. The appeal fee is $485 for a single-family dwelling property owner appealing the decision on his/her own property. The appeal fee is $1,540 for all other ap- peals. In addition, no special circumstances are applicable to the subject property, including size, shape, topography and lo- cation. Strict application of the zoning and subdivision ordinance does not deprive the subject property of privileges enjoyed by other properties in the vicinity and under identical zone classification. Based on the submitted plans dated December 15, 2004, the southwest corner of the addition would have to be setback an additional 18-inches to comply with the minimum 15-foot front yard setback.
