Subject : WAIVER OF DEVELOPMENT STANDARDS REOUIREMENTS
Prior defining this addition. the designer hod inquired about corner property setbacks.
The requirement given was a diagonal with end points 25 feet each way from the theoritical
corner . The completed plans were subsequently submitted for plancheck . They were reviewed
at the planning counter, and approved for building check. Three weeks toter, when both building
and planning comments were returned . we learned that the "radius midpoint setback " requirement
was not met. The incursion into the setback is 1'-6"
When asked for the Zoning Code defining this midpoint setback we were informed that it was
still under development . Also, this verbal code has apparently been exercised for many years.
It seems logical that since the City has been unable to formalize this requirement for many
years. there must be unresolved Issues.
The impacted area is a bedroom . Allowing this design to remain as is will retain the required
bedroom size. as well as a balanced visual oppeoronce . This incursion does not exceed
the 10% deviation requirement.

WAIVER OF DEVELOPMENT STANDARDS
REQUIREMENTS

Step 1: Come to the Planning Counter to review your request with Planning Staff. Prior to submittal for a
building permit, the applicant is required to submit a written request to the Planning Department stating
how the proposal will improve the design of the project pursuant to the Huntington Beach Zoning and
Subdivision Ordinance, Chapter 241.22 Waiver of Development Standards.
A Standards Which Can Be Waived: The Director may waive development standards for setbacks,
open space, separation between buildings, height of buildings or fences, site coverage and
landscaping without a conditional use permit or a variance, only if he finds that such a waiver
improves project design and does not exceed 10 percent deviation.
B. Expiration: A waiver may become null and void six months after date of approval, unless exercised.
C. Extensions: A waiver may be extended up to one year. Additional extensions may be granted if the
applicant demonstrates that no circumstances relevant to the approval of the waiver, including other
development in the neighborhood, have changed from the time of approval. To initiate an
extension, applicant shall submit a written request to the Planning Department a minimum of thirty
days prior to expiration including an Extension Fee.
D. Limitations: A waiver may not be granted if the waiver would in any way degrade the environment
or result in any changes to classification of land use or to density.
E. Decisions and A eals: The Director's decision may be appealed in accord with Chapter 248. The
Director's decision shall be distributed to the City Council, Planning Commission, and Zoning
Administrator within 48 hours of such decision.
Step 2: The request for a waiver of development standards shall be in writing and include the following:
a) Name of applicant
b) Phone number and property address.
c) Authorization from property owner.
d) Three sets of plans fully dimensioned.
e) Narrative stating specific request and how the proposal improves the project design.
f) Waiver of Development Standards Request Letter. (Courtesy letter provided)
Step 3: The requests are typically processed in two weeks. You will be notified in writing of the Department's
decision. At the time of submittal for building permit, the applicant shall include the approval letter of
Waiver of Development Standards with plans.

PLANNING & ZONING CORRECTIONS:
1. The min. 15'-0" front setback is measure through the midpoint of the corner radius perpendicular to
the Papua. As a result a portion of the proposed addition encroaches into the front setback
2. Depict a min 10'-0" rear setback (remove "verify"), and a min. 10'-0" street side setback
3. Any ancillary use (e.g. residential day care, alcohol recovery, etc) if different from single family
residential use shall be disclosed. All applicable state permits shall be obtained.
4. On floor plan, identify uses of rooms at front entry and in front of the rear most bedroom
5. The existing storage shed requires to be setback a min 5' from the rear property line and shall
maintain a min. 10' from the main dwelling.
6 The following fees shall be paid prior to issuance of building permits. These fees are in addition to
all normal fees and assessments
Park Fee - $1066.40 based on $0.86 per sq. ft. of new floor area (habitable/garage)
