DECLARATION OF COVENANTS, CONDITIONS
AND RESTRICTIONS AFFECTING REAL PROPERTY
This Declaration of Covenants, Conditions and Restrictions is made as of
Au t 21 2009 by Prince Herzog hereinafter referred to as "Declarant."
WHEREAS, Declarant is the owner of the real property located at 5322 Oceanus Drive in
the City of Huntington Beach (hereinafter referred to as the "Subject Property") more particularly
described as Lot 13 of Tract No. P0121, Block 29 in the City of Huntington Beach, County of
Orange, State of California, as shown on a Map filed in Book 121, Pages 29 and 30 of
Miscellaneous Maps, Records of Orange County, California; and
Declarant has applied to the City of Huntington Beach (hereinafter referred to as the
"City") for permission to construct office and warehouse space in conjunction with the
manufacture use within the existing 11,335 square foot industrial building on the Subject
Property; and
Declarant desires to establish' certain covenants, conditions and restrictions which shall
run with the Subject Property for the purpose of enhancing and protecting the value, desirability
and attractiveness of the Subject Property.
NOW THEREFORE, Declarant does hereby certify, agree and declare that the Subject
Property, and each portion thereof, shall be held, used, leased, sold, and conveyed subject to each
and all of the covenants, conditions and restrictions contained herein, each and all of which are
hereby declared to be for the benefit of all the Subject Property and each portion thereof, and
each present and future owner thereof, and Declarant. These covenants, conditions and
restrictions shall run with the Subject Property and each portion thereof, and shall be binding
upon all parties having or acquiring any right, title or interest in the Subject Property or any
portion thereof, and shall inure to the benefit of and bind each Owner thereof and their respective
successors in interest, and are imposed upon the Subject Property and each and every portion
thereof as the dominant tenement or tenements, all of which follows, to wit:
1. That the industrial building on the Subject Property, as approved and authorized
by the City pursuant to Administrative Permit No. 2009-011 and Building Permit Nos. B2009-
004364 and 2009-004365 will be used only as shown on the approved plans.
2.That 18 parking spaces shall be provided at the following ratios:
First floor
Office -1,038 sq. ft. @ 1/500 sq. ft. (under 10%) =2.10 spaces
Manufacture 6,215 sq. ft. @ 1/500 sq. ft. =12.43 spaces
Warehouse - 4,082 sq. ft. @ 1/1000 sq. ft. =4.10 spaces
Total parking spaces required 18.63 spaces
Total parking spaces provided =18 spaces
3. That there shall be no changes, alterations, or deletions to the building with the
addition without the express prior written approval of the City first had and obtained.
4. That these covenants, conditions and restrictions shall run with the Subject
Property in perpetuity, and shall be binding upon the undersigned Declarant owner, his heirs,
successors, and assigns, and any future owners of the Subject Property and their heirs, successors
and assigns, unless otherwise released by written instrument approved and authorized by the
City.
