In your letter you ask whether you can build two homes on two of the six lots comprising a development consisting of a motel with associated parking, landscaping and a swimming pool. In order to answer your questions, a thorough research of the site's history, entitlement and building permit files was conducted along with a zoning analysis. The initial research indicates that the motel site has been in operation since approximately 1958. The primary question is whether the pool for the existing motel on the subject property could be demolished/eliminated to permit the construction of two single family residential units. The original building permits and Certificate of Occupancy reveal that an 18 unit motel was built in 1958 and a pool was added in 1961 as an amenity to the motel site. In 1983, the City approved Administrative Review No. 82-49, Use Permit No. 83-2• and Negative Declaration. No. 83-1, a request to permit the expansion of the motel site. However, construction associated with the entitlements were not pursued as a result of the adjacent property owner rescinding authorization for the consolidation of the two lots with the motel property as required by a condition of approval. We have attached some of the background information for your review. With the adoption of the Downtown Specific Plan (SP 5) in 1983, the motel site became a non-conforming use. As a result, any development proposed at the site is subject to the non- conforming provisions of SP 5. Pursuant Section 4.2.01, General Provisions, and further clarified by Planning Policy No. 69 (attached), rehabilitation proposals must meet certain criteria. Based on this information, it has been determined that if a development consists of rehabilitation. an expansion of less than 1011%%. or demolition of less than 10% to existing facilities, approval of a conditional use permit is required.
