With your letter you included conceptual plans that are intended to reflect compliance with the recommendations and code requirements identified in our December 19, 2007, IPZR No. 07-008 letter. Specifically, the plans reflect modifications to the north and west elevations of Building "C" which comply with the Huntington Beach Zoning and Subdivision Ordinance (HBZSO) requirement that commercial buildings not exceed a height of 18 ft. when located within 45 ft. of a residential district. Subsequently, you submitted for consideration an interpretation of the aforementioned height requirement as applicable to Wing "B". Although Planning staff concurs that the design generally meets the intent of the HBZSO, it remains staff's position that the proposed building height of 40 ft. does not strictly comply and may be incompatible with the adjoining residential properties. Therefore, redesign of the project or a variance to the overall building height would be necessary. Planning Staff may support such a variance request if the design of Wing "A" and "B" is modified to ensure that all rooftop decks and other similar features are oriented toward Pacific Coast Highway and away from adjacent residences. The separation of the proposed buildings from the adjacent residential structures is 80'-100' greatly reducing any impact. In addition, the portion of the proposed buildings above the 18' elevation is comprised of only residential uses, all commercial activities are on the first floor. The building facade and roofline of building "C" can comply with the 18' height limit within 45' of residential uses code provision; however, the resulting building design is less desirable. The commercial portions of wing "A" & "B" will be designed below 18' in height. The proposed design is consistent with the intent of the code provision. Please let us know if these modifications adequately address the code provisions. The architect will then revise the drawings to address the other comments from your letter dated December 19, 2007, and we will formally re- submit following the community meeting scheduled for the beginning of March. The comments provided in this letter reflect Planning Department review only and are lim- ited to the information provided with the application submittal. Additional issues, which may be of concern to other departments, are not addressed as a part of this application. Please note that addi- tional issues may be identified following submittal of complete plans and/or applicant for entitle- ments. Zonin / Genera Plan: The project site is located within the Commercial Visitor (CV) zoning district. The General Plan des- ignation for the subject property is CV-F2-d (Commercial Visitor - 0.50 maximum floor area ratio - Design Overlay). Initial Plan Zoning Review N . 2007-008 Page 2 Re uired Permits/Entitlements: 0 The mixed use proposal (commercial/retail and residential), permitted under the Huntington Beach Zoning and Subdivision Ordinance (HBZSO), is consistent with the land use/community district and subarea schedule of the General Plan/Coastal Element. The inconsistency is due to the fact that the General Plan/Coastal Element is silent with respect to the residential component of any mixed- use proposal. Permitting mixed use under the General Plan CV land use catego ry will require the following: General Plan Amendment (GPA) with review by the Huntington Beach Planning Commission, City Council and California Coastal Commission in conjunction with an associated filling fee of $32,948. Local Coastal Program Amendment (LCPA) with review by the Huntington Beach Planning Commission, City Council, and California Coastal Commission in conjunction with an associated filling fee of $7,306. Environmental Assessment (EA) with review by the Huntington Beach Planning and City Council in conjunction with an associated filling fee of $7,225. • Conditional Use Permit (CUP) required pursuant to HBZSO Section 211.04 with review by the Planning Commission for the mixed-use/new construction project in conjunction with an associ- ated filling fee of $3,568. Coastal Development Permit (CDP) for development within the appealable jurisdiction of the coastal zone with review by the Planning Commission in conjunction with an associated filling fee of $2,894. Code Re uirements: Prior to submittal for entitlement processing, project plans should be revised to demonstrate con- formance with all applicable requirements of the Huntington Beach Zoning and Subdivision Ordi- nance (HBZSO), including but not limited to the standards identified below, by means of accurate and fully dimensioned plans 1. The easterly portions of buildings "Wing C" and "B" shall minimize the overall height of the struc- tures so as not to exceed an overall height of 18 ft. when located within 45 ft. of the adjoining residential district (easterly prope rty line). (HBZSO Sect. 211.06) 2. A minimum of 2 on-site parking spaces shall be provided for each dwelling unit located in the Coastal Zone which will result in 15 additional onsite parking spaces in conjunction with the 127 spaces provided. (HBZSO Sect. 231.18) 3. Residential parking shall be designated and identified on the plans. Each studio dwelling unit shall have enclosed assigned parking spaces separate and accessible only to the residential unit for which they serve. Each residential parking space shall be within 200 ft. walking distance to the unit for which it is assigned. (HBZSO Sect. 231.18) 5. The provided 5 ft. landscape strip adjacent to Pacific Coast Highway shall be increased an addi- tional 5 ft. The 2 ft. overhang into the landscape planter shall not count towards the minimum required 10 ft. landscaping planter. (HBZSO Sect. 232.08) 6. A minimum of 3 ft. of plantable width shall be provided along the perimeter of the proposed park- ing area specifically along the northwest section of the prope rty. (HBZSO Sect. 232.08) 7. In addition the two provided trees in the submitted site plan, an additional seven (7) 36-inch box trees shall be provided within the first 15 ft. of the setback area adjacent to the a street. (HBZSO Sect. 232.08) 8. Interior landscaping areas shall be distributed throughout the parking area and shall equal 5 per- cent of the perimeter landscaping area. (HBZSO Sect. 232.08 C-3) 9. A minimum of thirteen (13) 24-inch box trees shall be located throughout the parking area. (HBZSO Sect. 232.08 C-3) 10. 8 bicycle parking spaces shall be provided onsite and conveniently located close to the building entrances as possible for patrons and employees, and protected from damage by automobile. (HBZSO Sect. 231.20) Desi n Recommendations: The following items are staff recommendations to improve the design of the project consistent with the City's adopted design guidelines, policies, and or design principles: 1. Pursuant to the City's Urban Design Guidelines (UDG), it is encouraged that as an amenity the roof top decks serving the 3rdfloor residential units be oriented toward Pacific Coast Highway in an effort to provide an ocean view and avoid direct views to residentially zoned properties. (UDG: Ch. 3: B) 2. Decorative paving should be incorporated into project site planning design including but not lim- ited to driveway entries, pedestrian walkways and crosswalks. (UDG Ch. 3: C-11 a) 3. The proposed refuse enclosure should be architecturally compatible with the project design. Landscaping shall be incorporated into the design to screen it and deter graffiti. (UDG Ch. 3: C- 8a) 4. Trash enclosures should be unobtrusive and conveniently accessible for trash collection but should not impede circulation during loading operations. (UDG Ch. 3: C-9b) 5. The proposed refuse area should be located away from the northern residential properties in or- der to minimize any nuisances. The refuse area should be sited in a location with adequate dis- tance from the uses for which they serve. Linkages (e.g. walkways, common landscape areas, building orientation) between the proposed commercial and neighboring residential uses area encouraged where appropriate. (UDG Ch. 4 C-2d) 7. The elevator, stairways, and entrances to residential units shall be designed to be exclusively accessible to the residential tenants for whom they serve and segregated from commercial pa- trons and employees. The separation between public and private spaces can be achieved with paving, building materials, grade separations or with physical barriers. As we indicated, we are preparing to submit applications for a General Plan Amendment-minor ($17,998), a Local Coastal Plan Amendment ($7,306), an Environmental Assessment ($7,255), a Conditional Use Permit ($8,552), a Coastal Development Permit ($2214.50) and a Tentative Tract Map ($21,150). Total application fees for this request are $64,475.50. However, we would prefer a preliminary indication that the project will be favorably received. Enclosed are the various project narratives, zoning conformance matrix, Environmental Assessment and three sets of plans. At that meeting you requested information with respect to the processing requirements for the mixed-use (commercial/retail and residential) development of the "Sam's Seafood" site located at 16276-16278 Pacific Coast Highway. This site has a General Plan land use designation of Commercial Visitor (CV-F2-d) and a zoning designation of Commercial Visitor (CV). The CUP, CDP and EA will be processed concurrently with the GPA and LCPA to the Planning Commission to aid with the streamlining of the permitting process. Prior to project submittal, Planning Staff recommends that a community outreach meeting be coordinated with surrounding property owners and tenants in order to present and address any comments or concerns citizens may have with respect to the proposed project. This subject meeting is encouraged because it should provide an opportunity to modify the project based on citizen input and facilitate potential support for the project proposal. The community outreach meeting will not involve the City and shall be conducted by the applicant and those affiliated with the project. Please consult with Planning Staff prior to the meeting date regarding noticing requirements. Be advised that the abovementioned processing information is based on the conceptual nature of the project and can change based on any unforeseen variations to the development. To aide with streamlining the internal review process and ensure that the proposed project moves efficiently, the City of Huntington Beach has established a Development Assistance Team (DAT) that meets every Thursday at 10:00 AM. You may also request for a pre-application meeting with Planning Staff to review the project prior to submittal. An appointment with the DAT or a pre-application meeting can be scheduled at the Planning Department located on the third floor of City Hall or call at (714) 536-5271.
