LOCATION: 1112 Park Street, Huntington Beach, CA 92648 DATE OF ACTION: October 24, 2006 Dear Mr. Dahl: On October 24, 2006, the Planning Department of the City of Huntington Beach took action on your request and denied your request with findings. Attached to this letter are the findings for denial on your application. Under the provisions of the Huntington Beach Zoning and Subdivision Ordinance, the action taken by the Department of Planning is final unless an appeal is filed to the Planning Commis- sion by you or by an interested party. A person desiring to appeal the decision shall file a writ- ten notice of appeal to the Secretary of the Planning Commission within ten calendar days of the date of the Planning Department's action. The notice of appeal shall include the name and address of the appellant, the decision being appealed, and the grounds for the appeal. A filing fee of $494 shall also accompany the notice of appeal. Said appeal must be in writing and must set forth in detail the action and grounds by which the applicant or interested party deems himself aggrieved. The last day for filing an appeal and paying the filing fee for the above noted application is November 3, 2006. I FINDINGS FOR DENIAL - ADMINISTRATIVE PERMIT NO. 06-20: 1. The proposal to increase the 50 percent maximum lot coverage to 53.2 percent for a new single-family residence by incorporating architectural components such as a cantilevered second story in the interior courtyard of the structure, roof overhangs, and a balcony does not directly improve the design of the project. 2. No special circumstances are applicable to the subject property, including size, shape, to- pography, and location. Strict application of the zoning and subdivision ordinance does not deprive the subject property of privileges enjoyed by the other properties in the vicinity and under identical zone classification. Attached to this letter are the findings and conditions of approval for your application. This action will supercede the action taken by the Director of Planning on October 24, 2006. Under the provisions of the Huntington Beach Zoning and Subdivision Ordinance, the action taken by the Department of Planning is final unless an appeal is filed to the Planning Commis- sion by you or by an interested party. The proposed lot coverage of 53.2% percent does not exceed a 10% deviation from the maximum allowed lot coverage of 50% applicable in the RL (Residential Low Density) base zoning district, pursuant to Section 210.06 of the Huntington Beach Zoning and Subdivision Ordinance. 2. The proposed residence enhances the curb appeal of the subject area by incorporating a distinct architectural style that includes wide overhanging eaves, cantilevered second floor portions, and a covered porch that contribute to the dwelling's total lot coverage. The above-mentioned details will enhance the project with no detrimental impacts to surrounding properties by complying with required side and rear yard setbacks and maximum height lim- its. 3. The number of proposed parking spaces located within the garage area complies with the intent of the residential off-street parking requirement, pursuant to Section 231.04 of the Hunting Beach Zoning and Subdivision Ordinance. The enlarged garage area contributes to the dwelling's lot coverage, but will not create detrimental impacts to surrounding properties by complying with required side and rear yard setbacks and maximum height limits. 4. The proposed dwelling would not otherwise require any discretionary permits, and will not in any way degrade the environment or result in any changes to land use. With the exception of the proposed 53.2% lot coverage, the proposed dwelling conforms to all applicable devel- opment standards, including maximum height, minimum front and side yard setbacks, and maximum floor area ratio. The proposed 3.2% percent increase in lot coverage will not re- sult in significant environmental impacts. The existing dwelling will be used for single-family residential purposes. CONDITIONS OF APPROVAL - Administrative Permit No. 06-20R 1. The site plan, floor plans, and elevations received and dated October 12, 2006, shall be the conceptually approved layout. INFORMATION ON SPECIFIC CODE REQUIREMENTS 1. The applicant and/or applicant's representative shall be responsible for ensuring the accu- racy of all plans and information submitted to the City for review and approval. 2. Administrative Permit No. 06-20 shall not become effective until the ten-calendar day appeal period has elapsed. Administrative Permit No. 06-20 shall become null and void unless exercised within one year of the date of final approval or such extension of time as may be granted by the Director pursuant to a written request submitted to the Planning Department a minimum 30 days prior to the expiration date. 4. The Planning Department reserves the right to revoke Administrative Permit No. 06-20, pur- suant to a public hearing for revocation, if any violation of these conditions or the Huntington Beach Zoning and Subdivision Ordinance or Municipal Code occurs. 5. The development shall comply with all applicable provisions of the Municipal Code, Building Department, and Fire Department as well as applicable local, State and Federal Fire Codes, Ordinances, and standards, except as noted herein.
