On March 3, 2009 the Planning Department of the City of Huntington Beach took action on your request
and APPROVED your request with conditions. Attached to this letter are the conditions of approval for
your application.
Please be advised that the Department of Planning reviews the conceptual plan as a basic request for
entitlement of the use applied for and there may be additional requirements prior to issuance of building
permits. It is recommended that you immediately pursue completion of the conditions of approval and
address all requirements of the Huntington Beach Zoning and Subdivision Ordinance in order to
expedite the processing/completion of your project. The conceptual plan should not be construed as a
precise plan, reflecting conformance to all Zoning and Subdivision Ordinance requirements
Under the provisions of the Huntington Beach Zoning and Subdivision Ordinance, the action taken by
the Department of Planning is final unless an appeal is filed to the Planning Commission by you or by an
interested party. A person desiring to appeal the decision shall file a written notice of appeal to the

Secretary of the Planning Commission within ten calendar days of the date of the Planning Department's
action. The notice of appeal shall include the name and address of the appellant, the decision being
appealed, and the grounds for the appeal. A filing fee of $494 shall also accompany the notice of
appeal. Said appeal must be in writing and must set forth in detail the action and grounds by which the
applicant or interested party deems himself aggrieved. The last day for filing an appeal and paying the
filing fee for the above noted application is Thursday, March 12, 2009 at 5:00 p.m.

CONDITIONS OF APPROVAL - ADMINISTRATIVE PERMIT NO. 08-044
1. The site plan and elevations received and dated February 18, 2009 shall be the conceptually
approved design with the following modifications:
a The carts shall not occupy alternative cart location #2 and #3 concurrently.
b Exterior Cart Location #8 shall be relocated to the south side of Building A at a site reviewed
and approved by the Planning Department.
2. All carts shall maintain a minimum 1 ft. 6 in. clearance between the edge of the curb and the
outermost edge of the carts (i.e., footprint or canopy). All carts shall maintain a minimum 10 ft.
clearance between the edge of the adjacent buildings (excluding Cart Location #3 and #4), outdoor
dining areas, or other obstructions and the outermost edge of the carts.
3. All carts shall be removed and/or relocated to an alternative cart location should the minimum
clearance requirements not be met due to incorporation of future outdoor dining areas or other
similar obstructions.
4. A License Agreement, including use fees, shall be obtained from the City for portable vending carts
located in a public access easement. The applicant shall apply for and obtain approval of the license
agreement from the Public works Director prior to improvements or use of public easement.
5. The carts shall be sited to limit the length of power cords and associated cable protectors.
6. The total number of carts shall be limited to eight maximum.
7. All carts shall be repaired and maintained as necessary keeping a high-quality appearance.
8. The Director shall review the carts design and location for compliance with this approval at the end of
the first 2 years of operation.

The Design Review Board of the City of Huntington Beach took action on your application on
February 12, 2009 and continued the review of the proposed project to the February 26, 2009
Special Meeting. The Design Review Board (DRB) recommended additional information to
address concerns related to the design, placement, orientation, and operation of the kiosks
including impacts to the existing streetscape. Information requested by the DRB include the
following: 1) revised plans to clearly show: footprint of carts (including canopy overhang),
measurement of clear area for pedestrians (include potential queuing around carts), proximity to
potential outdoor dining areas and vehicular right-of-way, and relocation of impacted street
furniture; 2) identification of the location and detail of power cords to ensure public safety and
aesthetic compatibility; 3) an analysis of the best cart orientation and placement along 5th Street
showing alternative orientation and placement if appropriate; and 4) detail on how the proposed
kiosk design offers more individual design character and is compatible with the contemporary
Mediterranean character of The Strand
