Dear Ms. Alvarez:
Your application was acted upon by the Planning Department of the City of Huntington Beach on August
16, 2005 and your request was Conditionall A roved. Included in this letter are the Conditions of Ap-
proval of your application.
Under the provisions of the Huntington Beach Zoning and Subdivision Ordinance, the action taken by the
Planning Department is final unless an appeal is filed to the Planning Commission by you or by an inter-
ested party. Said appeal must be in writing and must set forth in detail the action and grounds by which
the applicant or interested party deems himself aggrieved. Said appeal must be accompanied by a filing
fee of one-thousand five-hundred and forty dollars ($1,540). The appeal shall be submitted to the Secre-
tary of the Planning Commission within ten (10) calendar days of the date of the Planning Department's
action.
The last day for filing an appeal and paying the filing fee for the above noted application is August 26,
2005.
Provisions of the Huntington Beach Zoning and Subdivision Ordinance are such that a Lot Line Adjust-
ment becomes null and void two (2) years after the date of final approval, unless executed by recordation.

It is recommended that you immediately pursue completion of the Conditions of Approval and address all
requirements of the Huntington Beach Municipal Code in order to expedite the processing of your total
application.

partment of the City of Huntington Beach, California, on August 16, 2005, upon the foregoing conditions

FINDINGS AND CONDITIONS OF APPROVAL
LOT LINE ADJUSTMENT NO. 05-09
FINDINGS FOR PROJECTS EXEMPT FROM CE A:
The Planning Department finds that the project will not have any signific ant effect on the environment
and is exempt from the provisions of the California Environmental Quality Act (CEQA) pursuant to sec-
tion 15305 of the CEQA Guidelines, because the project consists of a minor lot line adjustment, not re-
sulting in the creation of additional parcels nor a change in land use or increase in density, in an area with
an average slope of less than 20 percent.
FINDINGS FOR APPROVAL - LOT LINE ADJUSTMENT NO. 05-09:
1. The granting of Lot Line Adjustment No. 05-09 will not create any additional parcels or building sites.
The lot line adjustment provides for the consolidation of two contiguous lots into one lot.
2. The parcel resulting from Lot Line Adjustment No. 05-09 conforms to Titles 20-24 of the Huntington
Beach Zoning and Subdivision Ordinance. The subject property consists of two existing, legal non-
conforming lots to be merged into one 6,970 sq. ft. parcel, conforming to the 5,000 sq. ft. minimum lot
size applicable in the RL (Residential Low-Density) zoning district.
3. Lot Line Adjustment No. 05-09 will not sever any existing structure on the proposed parcel. The sub-
ject property is currently undeveloped.
4. Lot Line Adjustment No. 05-09 will not allow a greater number of dwelling units than allowed prior to
the adjustment. The subject property is zoned RL (Residential Low Density) which permits residential
development at a maximum density of one unit per 6,000 square-feet. The proposed lot consolidation
will provide for construction of a single dwelling unit on the subject property.
5. A plat map showing the lot line adjustment has been prepared and approved and will be filed in accord
with the provisions of Section 253.24 of the Huntington Beach Zoning & Subdivision Ordinance.

CONDITIONS OF APPROVAL - LOT LINE ADJUST MENT NO. 05-10:
1. The plat map stamped received and dated July 25, 2005, and maintained in Planning Department case
file LLA 05-09, shall be the approved layout.
2. The lot line adjustment form shall be modified as necessary, pursuant to the requirements of the Public
Works Department prior to recordation.
3. A copy of the recorded lot line adjustment form shall be submitted to the Planning Department prior to
issuance of building permits for construction on the subject property.
INDEMNIFICATION AND HOLD HARMLESS CONDITION:
The owner of the property which is the subject of this project and the project applicant if different from
the property owner, and each of their heirs, successors and assigns, shall defend, indemnify and hold
harmless the City of Huntington Beach and its agents, officers, and employees from any claim, action or
proceedings, liability cost, including attorney's fees and costs against the City or its agents, officers or
employees, to attack, set aside, void or annul any approval of the City, including but not limited to any
approval granted by the City Council, Planning Commission, or Design Review Board concerning this
project. The City shall promptly notify the applicant of any claim, action or proceeding and should coop-
erate fully in the defense thereof.
INFORMATION ON SPECIFIC CODE RE UIRE MENTS:
1. Lot Line Adjustment No. 05-09 shall not become effective until the ten-calendar day appeal period
has elapsed.
2. Lot Line Adjustment No. 05-09 shall become null and void unless recorded within two years of the
date of final approval, which is August 16, 2007 or such extension of time as may be granted by the
Director pursuant to a written request submitted to the Planning Department a minimum 30 days
prior to the expiration date.
3. The lot line adjustment shall comply with all applicable provisions of the Municipal Code, Building
Division, and Fire Department as well as applicable local, State and Federal Fire Codes, Ordinances,
and standards, except as noted herein.
