SUBJECT: LIMITED NOTIFICATION NO. 03-15 HE WORKOUT

REQUEST: To establish and operate a fitness studio (personal enrichment) within a 2,000
square foot tenant suite.

The Planning Department of the City of Huntington Beach conditional) a roved your
application on November 12 2003. Attached to this letter are the conditions of approval for your
application. You must submit this notice of action letter to the Building Department upon
requests for Certificate of Occupancy or Building Permit.
Under the provisions of the Huntington Beach Zoning and Subdivision Ordinance, the action
taken by the Planning Department becomes final at the expiration of the ten day appeal period.
A person desiring to appeal the decision shall file a written notice of appeal to the Secretary of
the Planning Commission within ten calendar days of the date of the Planning Department's
action. The notice of appeal shall include the name and address of the appellant, the decision
being appealed, and the grounds for the appeal. A filing fee of $485 shall also accompany the
notice of appeal.

CONDITIONS OF APPROVAL - LIMITED NOTIFICATION NO 03-15:
1. The floor plan received and dated October 30, 2003 shall be the conceptually approved
layout.
2. Prior to submittal for building permits zoning entitlement conditions of approval shall be
printed verbatim on one of the first three pages of all the working drawing sets used for
issuance of building permits (architectural, structural, electrical, mechanical and plumbing)
and shall be referenced in the sheet index. The minimum font size utilized for printed text
shall be 12 point.
3. The use shall comply with the following:
a. The maximum number of persons per class shall not exceed the number of parking spaces
allocated to the unit. Based on the square footage of the unit designated for the personal
enrichment use (2,000 square feet) the number of parking spaces allocated is ten (10)
based on prior retail use; therefore, the maximum class size shall not exceed ten (10)
participants. (Code Requirement)
b. The instruction area shall not exceed 75 percent of the total floor area of the tenant suite
(maximum 1500 square feet of the 2,000 square foot unit). (Code Requirement)
4. The applicant shall be responsible for ensuring the accuracy of all plans and information
submitted to the City for review and approval.
5. The Planning Director ensures that all conditions of approval herein are complied with. The
Planning Director shall be notified in writing if any changes to the plans are proposed as a
result of the plan check process. Building permits shall not be issued until the Planning
Director has reviewed and approved the proposed changes.
INFORMATION ON SPECIFIC CODE RE UIREMENTS:
1. Limited Notification No. 03-15 shall not become effective until the ten-calendar day appeal
period has elapsed.
2. Limited Notification No. 03-15 shall become null and void unless exercised within one year
of the date of final approval, which is November 12, 2004, or such extension of time as may
be granted by the Director pursuant to a written request submitted to the Planning
Department a minimum 30 days prior to the expiration date.
3. The Planning Department reserves the right to revoke Limited Notification No. 03-15,
pursuant to a public hearing for revocation, if any violation of these conditions or the
Huntington Beach Zoning and Subdivision Ordinance or Municipal Code occurs.

4. The development shall comply with all applicable provisions of the Municipal Code,
Building Division, and Fire Department as well as applicable local, State and Federal Fire
Codes, Ordinances, and standards, except as noted herein.
5. A Certificate of Occupancy must be approved by the Planning Department and issued by
the Building and Safety Department prior to occupying the building.
