Box 2653, Costa Mesa, CA 92628 Subject:LIMITED SIGN PERMIT NO. 90-4 Your application was acted upon by the Huntington Beach Planning Commission on August 7, 1990 and your request was: WITHDRAWN APPROVED APPROVED WITH CONDITIONS XX (see attached) DISAPPROVED TABLED CONTINUED UNTIL Under the provisions of the Huntington Beach Ordinance Code, the action taken by the Planning Commission is final unless an appeal is filed to the City Council by you or an interested party. Said appeal must be in wr4.ting and must set forth in detail the actions and grounds by and upon which the applicant or interested party deems himself aggrieved. Said appeal must be accompanied by a filing fee of two hundred ($200) dollars and be submitted to the City Clerk's office within ten (10) days of the date of the Commission's action. In your case, the last day for filing an appeal and paying the filing fee is ..igust 17, 1990 Provisions of the Huntington Beach Ordinance Code are such that any application becomes null and void one (1) year after final approval, unless actual construction has started. BOX 190 CALIFORNIA 92648 August 9, 1990 SUBJECT: LIMITED SIGN PERMIT NO. 90-4 REQUEST: To modify (race change) an existing nonconforming freestanding pole sign and extend the use of the sign for two (2) years. LOCATION: 9842 Adams Street (south side of Adams Street approximately 300 feet west of Brookhurst) DATE OF APPROVAL: August 1990 FINDINGS FOR APPROVAL -- LIMITED SIGN PERMIT NO. 90-4: 1. Allowing the maintenance of the sign for an additional two years will not adversely affect other signs in the area. 2. The proposed sign face change will not be detrimental to property located in the vicinity of such sign, and will be in keeping with thy: character of the surrounding area. 3. The sign in its existing location along Adams Avenue will not obstruct pedestrian or vehicular traffic vision. 4. Due to the unique circumstances applicable to the sign, immediate alteration, removal or replacement of the sign will result in a substantial economic hardship. CONDITIONS OF APPROVAL - LIMITED SIGN PERMIT NO. 90-4: 1. The site pl..n and sign elev2',.ion received and dated July 10, 1990, shall be the conceptually approved layout. Limited Sign Permit No. 90-4 Page Two 2. Limited Sign Permit No. 90-4 shall be valid for two years (until August 7, 1992). 3. Prior to issuance of building permits, the applicant shall file a cash bond in the amount of $5,000 with the City for the purpose of indemnifying the City for any and all costs incurred in the removal of the sign. If the sign is not made to conform with the applicable provisions of the sign ordinance after two years from the date of approval, or remodel of the property, whichever comes first, the City of Huntington Beach or its agents or employees may enter the property where said sign is located and remove said sign and the cost of removal shall I-e deducted from the cash bond and summarily forfeited and paid over to the city of Huntington Beach, and the remainder, if any, returned to the person depositing the bond. 4. Limited Sign Permit No. 90-4 shall not become effective for any purpose until an "Acceptance of Conditions" form has been properly executed by the applicant and an authorized representative of the owner of the property, and returned to the Planning Division; and until the ten day appeal period has elapsed. I hereby certify that Planned Sign Program No. 90-4 was approved by the Planning Commission of the City of Huntington Beach on August 7, 1990 upon the foregoing findings and conditions. This approval represents conceptual approval only; detailed plans must be submitted for review and the aforementioned conditions completed prior to final approval.
