The applicant is requesting the face change as a result of a change of business name from Bob's Big Boy Restaurant to a Music Plus music and video store. D-2 A-FM-23C J. Section 9610.8(c) of the Huntington Beach Ordinance code specifies that the Planning Commission may allow a change of face for nonconforming signs and extend their use for up to two years. A cash bond is required to guarantee the removal of the sign upon expiration of the extension of time. 3.0 SURROUNDING LAND USE ZONING AND GENERAL PLAN DESIGNATIONS: North East and South of Sub'ect Pro ert : GENERAL PLAN DESIGNATION: General Commercial ZONE: C4-FP2 (Highway Commercial-Floodplain) LAND USE: Commercial-Retail Center West of Sub'ect Pro ert : GENERAL PLAN DESIGNATION: Low Density Residential ZONE: Rl-FP2 (Medium-High Residential -Floodplain) LAND USE: Residential 4.0 ENVIRONMENTAL STATUS: The proposed project is categorically exempt pursuant to Class 11, Section 15311 of the California Environmental Quality Act. 5.0 COASTAL STATUS: Not applicable. 6.0 REDEVELOPMENT STATUS: Not applicable. 7.0 SPECIFIC PLAN: Not applicable. 8.0 SUBDIVISION COMMITTEE: Not applicable. 9.0 ISSUES AND ANALYSIS: The following is a zoning conformance matrix which compares the existing sign with the current sign code requirements of Article 961. Staff Report - 8/7/90 -2- (6687d) The existing 32 foot high freestanding pylon sign provides 160 square feet of sign area which identified the former Bob's Big Boy Restaurant. As a result of a change of business ownership to Music Plus, the applicant is requesting a limited sign permit to change the face of the existing pylon size for a temporary two year period. The face change includes: tenant identification and a logo. The applicant/owner has met the intent of the limited sign permit by requesting a change of face only and understands that the permit is for a maximum period of two years. After the two year period the sign shall be made to conform to the current code requirements for signs (maximum 50 square feet in area and 7 feet in height). 10.0 RECOMMENDATION: Staff recommends that the Planning Commission approve Limited Sign Permit No. 90-4 with the following findings and conditions of approval: FINDINGS FOR APPROVAL - LIMITED SIGN PERMIT NO. 90-4: 1. Allowing the maintenance of the sign for an additional two years will not adversely affect other signs in the area. 2. The proposed sign face change will not be detrimental to property located in the vicinity of such sign, and will be in keeping with the character of the surrounding area. 3. The sign in its existing location along Adams Avenue will not obstruct pedestrian or vehicular traffic vision. 4. Due to the unique circumstances applicable to the sign, immediate alteration, removal or replacement of the sign will result in a substantial economic hardship. CONDITIONS OF APPROVAL - TI1iTED SIGN PERMIT NO. 90-4: 1. The site plan and sign elevation received and dated July 10, 1990, shall be the conceptually approved layout. 2. Limited Sign Permit No. 90-4 shall be valid for two years (until August 7, 1992). 3. Prior to issuance of building permits, the applicant shall file a cash bond in the amount of $2,000 with the City for the purpose of indemnifying the City for any and all costs incurred in the removal of the sign. If the sign is not made to conform with the applicable provisions of the sign ordinance after two years from the date of approval, or remodel of the property, whichever comes first, the City of Huntington Beach or its agents or employees may enter the property where said sign is located and remove said sign and the cost of removal shall be deducted from the cash bond and summarily forfeited and paid over to the city of Huntington Beach, and the remainder, if any, returned to the person depositing the bond. Limited Sign Permit No. 90-4 shall not become effective for any purpose until an "Acceptance of Conditions " form has been properly executed by the applicant and an authorized representative of the owner of the property , and returned to the Planning Division ; and until the ten day appeal period has elapsed. 11.0 ALTERNATIVE ACTION: The Planning Commission may deny Limited Sign Permit No. 90-4 with findings. This narrative is to accompany the package delivered by Quality Project Coordinating, and they are fully authorized to act as our agents in all matters pertaining to this project. I shall cover the points in the order in which the application outlines them. 1 (a) This application was initiated at the request of Music+plus (Show Industrie.,) who will be taking possession of the above property within the next month. The existing pylon sign is a legal non-conforming structure that was erected and utilized by the previous tenant (Bob's Big Boy). Music+plus requests that they be able to reface the existing cabinets according to the accompanying plans. No structural or electrical changes will be made. (b) The project is located on Adams Street with the nearest major intersection being Brookhurst. It is commercially zoned, and will serve the population of southern Huntington Beach. (c) Music+plus is a Los Angeles based entertainment retail chain specializing in the sale of Compact Discs, Tapes, Records; and the rental and sale of Video Cassettes. They currently have 76 locations throughout California. The proposal to reface the pylon, is to provide adequate identification for Music+plus to establish its presence in Huntington Beach. (d) The surrounding area is commercial to the North (Mervyns), South and East (Target); and residential to the West. 2. (a) The exceptional circumstances applying to this property are self evident in that the pylon exists. Brookhurst is the main arterial and, due to the setbacks of the buildings from Adams, both Target and Bob's Big Boy set up pylons so as to be visible from Brookhurst (the distance from the existing pylon to the centerline of Brookhurst is 833'+/-). Music+plus would like not to be deprived of privileges previously enjoyed by Bob's Big Boy, and currently enjoyed by Target. 1057 solano avenue p.o. box 6153 albany, ca 94706 415/526-0296 (b) This request will not grant special privilege to Music+plus inconsistent with norm 4L limitation for the reasons stated above. ^ (c) We believe this request to be necessary for the preservation of the &dequ,ate identification for this property: A right which is currently enjoyed by this Property,. and one which Music+plus wishes to maintain. (d) Finally, we believe that not only will the granting of this request not ba-materiaily detrimental to the public welfare but it will be a positive attribute to that v veifare..°' Proper and effective identification and advertising of a retail business benefits bofrr'. the retailer and the public who wish to find him/her. Establishing oneself in a market area is vital to the success of any and all businesses as it is to the public that will support it. Music+plus has proven its worth in many communities, and anticipates a great future in the new Huntington Beach location. It is understood that this request is for a Limited Sign Permit, and that Music+plus is willing to provide a bond to insure that this non-conforming pylon be removed after a two year period. To confirm good faith towards this end, we have designed a new monument sign, inkeeping with the new codes to replace the existing pylon after two years. We are hoprful that, once established in the neigorhood, Music+plus will be adequately identified by the smaller sign. Thank you for your consideration.
