To permit a restaurant expansion (Macaroni) into
an adjacent , 1,200 square foot commercial suite
pursuant to Section 9220 .1 of the Huntington Beach
Ordinance Code . The request includes a five (5)
space parking variance for the commercial center
(95 spaces provided in lieu of 100 spaces
required).

Your application was acted upon by the Zoning Administrator of the
City of Huntington Beach on March 17, 1993, and your request was
Included in this letter are the Conditions of
Approval for this application.
Under the provisions of the Huntington Beach Ordinance Code, the
action taken by the Zoning Administrator is final unless an appeal is
filed to the Planning Commission by you or by an interested party.
Said appeal must be in writing and must set forth in detail the action
and grounds by which the applicant or interested party deems himself
aggrieved . Said appeal must be accompanied by a filing fee of Two
Hundred Dollars ($200.00 ) and submitted to the Secretary of the
Planning Commission within ten (10) calendar days of the date of the
Zoning Administrator 's action.
The lase. day for filing an appeal and paying the filing fee for the
above noted application is April 5, 1993.
Provisions of the Huntington Beach Ordinance Code are such that any
application becomes null and void one (1) year after the final
approval , unless actual construction has begun.

a.The general welfare of persons residing or riorking
the vicinity. With the conditions imposed, the
expansion will not impact adjacent businesses.

b.Property and improvements in the vicinity of such use
or building . All improvements currently exist to the
site . The expansion will allow for handicap bathrooms,
an office and waiting area.
2. The granting of Use Permit No. 93-3 will not adversely affect
the General Plan of the City of Huntington Beach. The proposed
restaurant expansion is consistent with the goals and
objectives of the General Commercial Land Use designation of
the General Plan.

1. The granting of Conditional Exception No. 93-5 for a five (5)
space parking variance will not constitute a grant of special
privilege Inconsistent upon other properties in the vicinity
and under an identical zone classification. The granting of
Conditional Exception No. 93-5 is necessary to provide handicap
facilities and an office area for the existing restaurant.
2. 3ecause of special circumstances applicable to the subject
property , including shape, location or surroundings, the strict
application of the Zoning Ordinance is found to deprive the
subject property of privileges enjoyed by other properties in
the vicinity and under identical zone classifications. Due to
the long, rectangular configuration of the parcel , the property
is required to have a ten (10) foot wide landscape planter
along the entire length of Beach Boulevard; it restricts the
parking lot design . Furthermore , the business does not have
rear access or parking, as there ir. a private alley located
directly behind the building.
3. The granting of Conditional Exception No. 93-5 is necessary in
order to preserve the enjoyment of one or more substantial
property rights . The granting of Conditional Exception 93-5
will allow for an expansion of Macaroni Restaurant to provide
handicap bathroom facilities , office , additional seating and
waiting area.
4. The granting of Conditional Exception No. 93-5 will not be
materially detrimental to the public welfare, or injurious to
property in the same zone classifications . With the conditions
imposed , the expansion will not impact businesses or patrons of
the co mmercial center.

5. The granting of Conditional Exception No. 93-5 will not
adversely affect the General Plan of the City of Huntington
Beach . The restaurant c pansion is consistent with the General
Commercial Land Use designation of the General Plan.
NDITI N V .
1. The site plan , floor plans , and elevations received and dated
January 20, 1993 shall be the conceptually approved layout.
2. The Zoning Administrator shall be notified in writing if any
changes in building height, floor area , setbacks , building
elevations or open space are proposed as a result of the plan
check process . Building permits shall not be issued until the
Zoning Administrator has reviewed and approved the proposed
changes . The Zoning Administrator reserves the right to
require that an amendment to the original entitlement be
processed if the proposed changes are of a substantial nature.
3. Conditions of approval shall be printed verbatim an the cover
sheet of all working drawing sets submitted for plancheck.
4. All applicable Public Works fees shall be paid prior to
issuance of building permits.
5. "The applicant /owner shall be responsible for payment of
Traffic Impact fees prior to issuance of a Certificate of
occupancy and/or final building permit approval."
6. All building spoils, such as unusable lumber , wire , pipe, and
other surplus or unusable material, shall be disposed of at an
off-site facility equipped to handle them.
7. The applicant shall submit shop drawings depicting tenant
improvments to automatic sprinkler systems with details showing
sprinkler head locations and relocations.
8. The applicant shall submit seating plans to the Fire Department
depicting table locations, aisles and exits.
9. The business owner shall require all employees to park along
Beach Boulevard to provide more parking closer to the
commercial building.

1. The development shall comply with all applicable provisions of
the Ordinance Code, Building Division, and Fire Department.
2. The applicant shall meet all applicable local , State, and
Federal Fire Codes, Ordinances , and standards.

3. The applicant shall obtain the necessary permits from the South
Coast Air Quality Management District.
4. The Zoning Administrator reserves the right to revoke
Use Permit No. 93-3 if any violation of these conditions or the
Huntington Beach Ordinance Code occurs.
The Department of Community Development will perform a comprehensive
plan check relating to all Ordinance Code requirements upon
submittal of your completed structural drawings.
Please be advised that the Zoning Administrator reviews the
conceptual plan as a basic request for entitlement of the use
applied for in relation to the vicinity in which it is proposed.
The conceptual plan should not be construed as a precise plan
reflecting conformance to all Ordinance Code requirements.
It is recommended that you immediately pursue completion of the
Conditions of Approval and address all requirements of the
Huntington Beach Ordinance Code in order to expedite the processing
of your total application.
I hereby certify that Use Permit No. 93-3 and Conditional Exception
No. 93-5 were Conditionally Approved by the Zoning Administrator of
the City of Huntington Beach , California , on March 17, 1993, upon
the foregoing conditions and citations.
