This list is intended to help you through the permitting process and various stages of project implementation. It should be noted that this requirement list is in addition to any "conditions of approval" adopted by the Planning & Building Director. Please note that if the design of your project or site conditions change, the list may also change. JILL ARABE, ASSISTANT PLANNER (714) 374-5357 / JARABE@SURFCITY-HB.ORG TO PERMIT THE ESTABLISHMENT OF AN APPROXIMATELY 143 SQ. FT. OUTDOOR DINING AREA IN CONJUNCTION WITH AN EXISTING 1,489 SQ. FT. TAKE-OUT RESTAURANT. The following is a list of code requirements deemed applicable to the proposed project based on plans received and dated May 17, 2010. The list is intended to assist the applicant by identifying requirements which must be satisfied during the various stages of project permitting and implementation. A list of conditions of approval adopted by the Planning & Building Director in conjunction with the requested entitlement(s), if any, will also be provided upon final project approval. If you have any questions regarding these requirements, please contact the project planner. 1. Outdoor dining on private sidewalk areas shall provide a minimum eight (8) foot clear passage area for pedestrian access or a permanent cordon shall surround the outdoor dining area and a minimum five (5) foot clear passage area shall be provided. (SP-5 DOWNTOWN SPECIFIC PLAN) 2. No food or beverages of any nature shall be sold to any occupant or rider of any motor vehicle or bicycle. (SP-5 DTSP) 3. All provisions of the Huntington Beach Municipal Code and Zoning and Subdivision Ordinance shall apply. (SP-5 DTSP) 4. Any establishment that plans to serve alcoholic beverages in an outdoor dining area must obtain a new conditional use permit. (SP-5 DTSP) 5. Provide disabled accessible seating at outdoor seating. (CBC Sec 1104B.5) 6. Provide clear exit path through outdoor dining area, minimum 44" wide.
