NOTICE OF ACTION
SUBJECT: ADMINISTRATIVE APPROVAL NO. 03-02 LADOUCEUR RETAINING
WALL)

REQUEST: To permit the construction of a 30-foot long 39.5-inch high retaining wall along
the front property line in lieu of the maximum permitted height of 36 inches

The Planning Department reviewed and approved your request on May 29, 2003 for a Waiver of
Development Standards in accordance with Section 241.22 of the Huntington Beach Zoning and
Subdivision Ordinance (HBZSO). Attached to this letter are the findings and conditions of ap-
proval for your application. You must submit this notice of action letter to the Planning and
Building & Safety Departments upon request for a Building Permit.
Under the provisions of the Huntington Beach Zoning and Subdivision Ordinance, the action
taken by the Planning Department becomes final at the expiration of the ten-day appeal period.
A person desiring to appeal the decision shall file a written notice of appeal to the Secretary of
the Planning Commission within ten calendar days of the date of the Planning Department's ac-
tion. The notice of appeal shall include the name and address of the appellant, the decision being
appealed, and the grounds for the appeal. A filing fee shall also accompany the notice of appeal.
The appeal fee is $409 for a single-family dwelling property owner appealing the decision on
his/her own property. The appeal fee is $1,063 for all other appeals.

FINDINGS FOR PROJECTS EXEMPT FROM CE A:
The Planning Department finds that the project will not have any significant effect on the envi-
ronment and is exempt from the provisions of the California Environmental Quality Act (CEQA)
pursuant to Section 15305 of the CEQA Guidelines because the project consists of a minor al-
teration in land use limitations which will not result in any changes in land use or density.
FINDINGS OF APPROVAL - ADMINISTRATIVE APPROVAL NO. 03-02:
1. The proposed 39.5 inch high retaining wall in lieu of a maximum permitted height of 36
inches does not exceed 10 percent deviation from Section 230.88 (7)(d)(1) of the HBZSO.
2. The proposed retaining wall improves the design of the project by providing a more useable
front yard consistent with other properties in the vicinity that have a similar slope condition.
The proposed retaining wall will have a stucco finish and color to match the existing single
family dwelling for a cohesive appearance.
3. This proposal would not otherwise require any discretionary permits and will not in any way
degrade the environment or result in any changes to classification of the land use because it
involves a minor increase in the maximum permitted height for a retaining wall in the front
yard. The existing residential use of the property will remain. The retaining wall will com-
ply with the visibility requirements for any abutting driveway.
CONDITIONS OF APPROVAL - ADMINISTRATIVE APPROVAL NO. 03-02:
1. The site plan received and dated May 9, 2003 shall be the conceptually approved layout.
2. Prior to submittal for building permits zoning entitlement conditions of approval shall be at-
tached to the drawing sets used for issuance of building permits.
3. The Planning Director ensures that all conditions of approval herein are complied with. The
Planning Director shall be notified in writing if any changes to the plans are proposed as a re-
sult of the plan check process. Building permits shall not be issued until the Planning Direc-
tor has reviewed and approved the proposed changes for conformance with the intent of this
action and the conditions herein. If the proposed changes are of a substantial nature, an
amendment to the original entitlement may be required pursuant to the Huntington Beach
Zoning and Subdivision Ordinance. .
INFORMATION ON SPECIFIC CODE RE UIREMENTS:
1. Administrative Approval No. 03-02 shall not become effective until the ten-calendar day
appeal period has elapsed.
2. Administrative Approval No. 03-02 shall become null and void unless exercised within six
months of the date of final approval which is November 29, 2003 or such extension of time

as may be granted by the Director pursuant to a written request submitted to the Planning
Department a minimum 30 days prior to the expiration date.
3. The Planning Department reserves the right to revoke Administrative Approval No. 03-02
pursuant to a public hearing for revocation, if any violation of these conditions or the Hunt-
ington Beach Zoning and Subdivision Ordinance or Municipal Code occurs.
4. The development shall comply with all applicable provisions of the Municipal Code, Build-
ing Department, and Fire Department as well as applicable local, State and Federal Fire
Codes, Ordinances, and standards, except as noted herein.
5. Construction shall be limited to Monday - Saturday 7:00 AM to 8:00 PM. Construction
shall be prohibited Sundays and Federal holidays.
