LOCATION: 15744 Goldenwest Street (Southeast corner of Goldenwest Street and McFadden Avenue) PROJECT PLANNER: Amy Wolfe Dear Applicant: Your application was acted upon by the Zoning Administrator of the City of Huntington Beach on June 6, 2001, and your request was Denied. Included in this letter are the Findings of Denial for this application. Under the provisions of the Huntington Beach Zoning and Subdivision Ordinance, the action taken by the Zoning Administrator is final unless an appeal is filed to the Planning Commission by you or by an interested party. Said appeal must be in writing and must set forth in detail the action and grounds by which the applicant or interested party deems himself aggrieved. Said appeal must be accompanied by a filing fee of Two Hundred Dollars ($200.00) if the appeal is filed by a single family dwelling property owner appealing the decision on his own property and Six Hundred Ninety Dollars ($690.00) if the appeal is filed by any other party. The appeal shall be submitted to the Secretary of the Planning Commission within ten (10) calendar days of the date of the Zoning Administrator's action. The last day for filing an appeal and paying the filing fee for the above noted application is June 18, 2001. FINDINGS FOR PROJECTS EXEMPT FROM CE A: The Zoning Administrator finds that the project will not have any significant effect on the environment and is'exempt from the provisions of the California Environmental Quality Act (CEQA) pursuant to section 15303 of the CEQA Guidelines. The subject wireless communication facility proposal involves modification to the exterior of an existing structure, therefore, it is exempt from further environmental review. FINDINGS FOR DENIAL - CONDITIONAL USE PERMIT 01-07: 1. Conditional Use Permit No. 01-07 for the establishment, operation, and maintenance of a wireless communication facility on an existing monopole at Goldenwest College will be detrimental to the general welfare of persons working or residing in the vicinity and detrimental to the value of property and improvements in the neighborhood. New, additional antenna arrays are proposed to be attached on the 95 ft. high illegally constructed monopole at a height of 85 ft. above grade. The new antennas will be visible from and will adversely impact single-family residential uses west of the site across Goldenwest Street as well as existing developments north of the subject property, across McFadden Avenue. 2. The conditional use permit will not be compatible with surrounding uses due to the wireless communication structure's height and proximity to residential uses. 3. The proposed Conditional Use Permit No. 01-07 will not comply with the provision of the base district of the Huntington Beach Zoning and Subdivision Ordinance pertaining to maximum height of structures. The Huntington Beach Zoning and Subdivision Ordinance limits the height of structures within the Public-semipublic zone to 50 ft. The existing monopole exceeds the maximum allowable height by 45 ft. and the height of the monopole, measured to the top of the new antenna arrays, will exceed the maximum allowable height by 35 feet. 4. The granting of the entitlement plan amendment will adversely affect the General Plan. The project is inconsistent with the following Land Use Element design and development policy of the General Plan: a. LU 13.1.8: Ensure that the City's public buildings, sites, and infrastructure are designed to be compatible in scale, mass, character and architecture with existing buildings and pertinent design characteristics prescribed by this General Plan for the district or neighborhood in which they are located, and work with non-City public agencies to encourage compliance.
