On August 14, 2007, the Planning Department of the City of Huntington Beach took action on the above
mentioned application and APPROVED the request with conditions. Please note the action by the Planning

Department/Planning Director is appealable to the Planning Commission within ten calendar days from the date of
the action. An appeal of the action shall be filed with the Department of Planning along with the appeal fee of
$494. The last day for filing an appeal and paying the filing fee for the above mentioned application is Friday,
August 24, 2007 at 5:00 p.m.

Good Morning Mr. Piantoni,
I wanted to advise you of the status of your application for a waiver of development standards as it pertains to
the existing wall within your front yard setback.
Initially, the application for approval of your wall was met with two main issues: location and height.
The location of the wall is within the current setback requirement of three feet from the front yard property line. I
located the building plans for the lot, dated August/September of 1988, and was able to verify that the wall was
permitted and built at the same time as the main dwelling thus alleviating the issue of its location within the front
yard setback. The Planning Department has decided that the plans clearly indicate the location and original
dimensions and shall consider the wall's location permissible.
Currently, the issue stands with the height of the wall. The Administrative Permit you've submitted for
processing is an application for a waiver of development standards, as those standards apply to the wall.
Your home, currently located within the RMH-A (Medium-High Density Small Lot Residential) zone, allows walls
within the front yard setback up to a maximum height of 42". The building plans from 1988 indicate the wall was
built to those specifications. The waiver of development standards, per Huntington Beach Zoning and
Subdivision Ordinance Code (HBZSO) Chapter 241.22, allows for waivers in the event that the subject
standards: a) improve project design and b) do not exceed a 10% deviation. The plans of your wall as
submitted with your application dated July 11, 2007, indicate the maximum height of the wall within the front
yard setback and along the west and southwest portions of your lot to be 46". This height is within the allowable
range of the waiver of development standards.
However, during a site visit, I measured and documented that portions of your wall exceeded the maximum
allowable height of 46.2" in some places by as much as one inch. There appears to be a lack of cohesion along
the outer perimeter of the wall and there are differences in the height of the wall in different areas. I am
researching and discussing this issue, and I have elevated the project to include discussion with senior staff.
The issue of height as it applies to your wall could set a precedent in the neighborhood and we are considering
all aspects of such a decision. I am unable to advise you at this time to a concrete answer of approval or denial
but please be assured we are working to make a decision that is as beneficial as possible to all interests
involved in the assessment.
