Dahl, 18681 Amalia Lane, Huntington Beach, CA 92648 PROPERTY OWNER: Jason Chen, 6391 Beachview Drive, Huntington Beach, CA 92648 REQUEST : To permit a waiver of development standards, pursuant to Section 241.22 of the Huntington Beach Zoning & Subdivision Ordinance, to allow 54.6% lot coverage in lieu of the maximum allowed lot coverage of 50%, for the construction of an approximately 6,200 sq. ft., two-story, single-family residence which includes a 1,260 sq. ft. basement and attached 951 sq. ft. garage. LOCATION: 1019 12th Street, 92648 (north of 12th Street, between Main Street and Lake Street) DATE OF ACTION: May 19, 2009 Dear Applicant: On May 19, 2009 the Planning Department of the City of Huntington Beach took action on your request and APPROVED your request with conditions. Attached to this letter are the conditions of approval for your application. Under the provisions of the Huntington Beach Zoning and Subdivision Ordinance, the action taken by the Department of Planning is final unless an appeal is filed to the Planning Commission by you or by an interested party. A person desiring to appeal the decision shall file a written notice of appeal to the Secretary of the Planning Commission within ten calendar days of the date of the Planning Department's action. The notice of appeal shall include the name and address of the appellant, the decision being appealed, and the grounds for the appeal. A filing fee of $494 shall also accompany the notice of appeal. Said appeal must be in writing and must set forth in detail the action and grounds by which the applicant or interested party deems himself aggrieved. I FINDINGS FOR APPROVAL - ADMINISTRATIVE PERMIT NO. 09-008: 1. The proposed lot coverage of 54.6% does not exceed a 10% deviation from the maximum allowed lot coverage of 50% applicable in the RL (Residential Low Density) zoning district, pursuant to Section 210.06 of the Huntington Beach Zoning and Subdivision Ordinance. 2. The waiver of development standards improves the project with a contemporary Craftsman architectural theme that contains design components as a cross-gabled roof, widelunenclosed eave overhangs, partial-width front porch, and covered patio. Approximately 14% of the overall lot coverage will be unenclosed areas as the roof eaves, front porch, and covered patio which do not contribute to the building's overall mass. The covered open areas provide variations in building form and visual interest with distinguishable architectural features synonymous with the associated design theme. The project ensures no detrimental impacts to surrounding properties by complying with required yard setbacks, maximum height, and minimum off-street parking requirements. 3. The proposed project would not otherwise require any discretionary permits, and will not degrade the environment or result in any changes to land use. With the exception of the proposed 54.6% lot coverage, the project conforms to all applicable development standards, including maximum height, minimum yard setbacks, and required onsite parking. CONDITIONS OF APPROVAL - ADMINISTRATIVE PERMIT NO. 09-008 1. The site plan, floor plans, and elevations received and dated April 28, 2009, shall be the conceptually approved layout with the following modifications: a. The development matrix identified on sheet "T" shall be revised to identify a total lot coverage area of 5,873 sq. ft. and coverage percentage of 54.6%. 2. The project narrative dated April 28, 2009, shall be revised to specify that the project will consist of a total lot coverage area of 5,873 sq. ft. and coverage percentage of 54.6%. INFORMATION ON SPECIFIC CODE RE UIREMENTS 1. The applicant and/or applicant's representative shall be responsible for ensuring the accuracy of all plans and information submitted to the City for review and approval. 2. Administrative Permit No. 09-008 shall not become effective until the ten-calendar day appeal period has elapsed. 3. Administrative Permit No. 09-008 shall become null and void unless exercised within one year of the date of final approval or such extension of time as may be granted by the Director pursuant to a written request submitted to the Planning Department a minimum 30 days prior to the expiration date. 4. The Planning Department reserves the right to revoke Administrative Permit No. 09-008, pursuant to a public hearing for revocation, if any violation of these conditions or the Huntington Beach Zoning and Subdivision Ordinance or Municipal Code occurs. The development shall comply with all applicable provisions of the Municipal Code, Building Department, and Fire Department as well as applicable local, State and Federal Fire Codes, Ordinances, and standards, except as noted herein.
