The waiver of development standards is a request to permit a lot coverage of 52.3% in lieu of the maximum allowed lot coverage of 50% to allow a solid roofed porch. LOCATION: 624 12th Street (East side of 12th St. and south of Palm Ave.) DATE OF ACTION: September 17, 2004 Dear Mr. Beutler: The Planning Department of the City of Huntington Beach reviewed and approved your request with modifications on September 17, 2004, for a Waiver of Development Standards. Attached to this letter are the findings and recommended conditions of approval for your application. You must submit this notice of action letter to the Planning and Building & Safety Departments upon request for a Building Permit. Please be advised that the Department of Planning reviews the conceptual plan as a basic request for enti- tlement of the use applied for and there may be additional requirements prior to issuance of building per- mits. It is recommended that you immediately pursue completion of the conditions of approval and ad- dress all requirements of the Huntington Beach Zoning and Subdivision Ordinance in order to expedite the processing/completion of your project. The conceptual plan should not be construed as a precise plan, re- flecting conformance to all Zoning and Subdivision Ordinance requirements. Under the provisions of the Huntington Beach Zoning and Subdivision Ordinance, the action taken by the Department of Planning is final unless an appeal is filed to the Planning Commission by you or by an in- terested party. A person desiring to appeal the decision shall file a written notice of appeal to the Secre- tary of the Planning Commission within ten calendar days of the date of the Planning Department's action. The notice of appeal shall include the name and address of the appellant, the decision being appealed, Mr. Beutler/ AA 04-10 September 20, 2004 Page 2 of 4 and the grounds for the appeal. A filing fee shall also accompany the notice of appeal. The appeal fee is $485 for a single-family dwelling property owner appealing the decision on his/her own property. The appeal fee is $1,540 for all other appeals. Said appeal must be in writing and must set forth in detail the action and grounds by which the applicant or interested party deems himself aggrieved. The last day for filing an appeal and paying the filing fee for the above noted application is September 27, 2004. FINDINGS FOR APPROVAL: 1. The proposed lot coverage of 52.3% resulting from the construction of a new single family home with a solid roofed porch does not exceed a ten percent (10%) deviation from the maximum allowed lot coverage of 50% applicable in the RMH-A (Residential Medium High Density) base-zoning district, pursuant to Section 210 .06 of the Huntington Beach Zoning and Subdivision Ordinance. 2. The proposed 52.3% lot coverage will facilitate the reconstruction of an existing single family home and allow a solid roofed porch to enhance the appearance of the home along the street frontage. The new single family home will be constructed of high quality materials such as stone veneer, stucco, and concrete tile roof. The design of the structure includes window treatments, hipped roof, second floor balcony, and ground floor porch. The ground floor porch is oriented to the street and enhances the building's entrance. In addition, reconstruction of the single family home will include public im- provements to the alley. 3. The proposed reconstruction would not otherwise require any discretionary permits, and will not in any way degrade the environment or result in any changes to land use. With the exception of the pro- posed 52.3% lot coverage, the proposed addition conforms to all applicable development standards, including maximum height, and minimum front and side yard setbacks. CONDITIONS OF APPROVAL - ADMINISTRATIVE APPROVAL NO. 04-10: 1. The site plan and floor plans received and dated July 13, 2004, shall be the conceptually approved layout except for the following modification: The side of the porch opposite of the entrance of the house shall be provided with access from either the interior of the structure or with a minimum three foot wide walkway from the area in front of the entrance. 2. The front covered porch shall not be enclosed nor shall sidewalls be added pursuant to a covenant that shall be recorded on the property prior to issuance to Building Permits. The covenant shall be submitted to the Planning Department for review prior to recordation. Mr. Beutler/ AA 04-10 September 20, 2004 Page 4 of 4 3. Prior to submittal for building permits zoning entitlement conditions of approval shall be printed verbatim on one of the first three pages of all the working drawing sets used for issuance of build- ing permits (architectural, structural, electrical, mechanical and plumbing) and shall be referenced in the sheet index. The minimum font size utilized for printed text shall be 12 point. INDEMNIFICATION AND HOLD HARMLESS CONDITION: The owner of the property which is the subject of this project and the project applicant if different from the property owner, and each of their heirs, successors and assigns, shall defend, indemnify and hold harmless the City of Huntington Beach and its agents, officers, and employees from any claim, action or proceedings, liability cost, including attorney's fees and costs against the City or its agents, officers or employees, to attack, set aside, void or annul any approval of the City, including but not limited to any approval granted by the City Council, Planning Commission, or Design Review Board concerning this project. The City shall promptly notify the applicant of any claim, action or proceeding and should coop- erate fully in the defense thereof.
