Dear Mr. and Mrs. Warman This letter is in response to your letter, dated March 25, 2003, wherein you claim to have recently discovered two errors in the legal description of your purchase deed to the above referenced property. It is my understanding that you are claiming the two errors in the legal description appear to involve the existence and validity of a parcel two easement, benefiting your property, and the amount of property footage described in parcel three. Based on my investigation of the deeds recorded in the public records the errors you describe do not exist. In your letter you stated that the parcel two easement was not mentioned anywhere in the adjacent property deed. Whether or not the easement is mentioned in the deed of the adjacent property is immaterial to your rights to said easement. The pertinent question is whether or not the easement was created, and if so, has the right ever been extinguished. The public record shows that the subject easement was created on March 23, 1954, via instrument number 20887, in a deed from Peggy H. Anderson to W.R. McNatt and Ima McNatt. The public record does not reflect any subsequent extinguishment of the easement, therefore the easement still exists. A copy of the deed that created the easement is enclosed for your review you may want to provide a copy of the easement to your neighbor to confirm your claim to said easement. With regard to the property footage disclosed in parcel three, I am enclosing copies of the deeds which reflect the history of parcel three and the footage transferred by each deed. Prior to November of 1955 Roy and Frances Bentson owned all of lot five. In a deed recorded in November of 1955, as instrument number 148228, the Bentsons sold the Southwesterly 15 feet of lot five to the McNatts. The McNatts subsequently sold all of the property disclosed under the two previously mentioned deeds to the Bentsons in a deed recorded April 16, 1959 in Book 4671, Page 119. A copy of said deed is enclosed for your reference. Eric and Nicole Warm March 31, 2003 Page 2 The Bentsons then sold said property to Charles and Alice Stone with one small difference. Under parcel three, only the Southwesterly 13 feet of lot 5 was transferred to the Stones. This was two feet less than what was transferred in the 1959 deed to the Bentsons. Why this was done is unclear. At the time, the Bensons did own the remaining portion of lot five and may have wanted to retain the two feet. The Bentsons subsequently sold lot five, excepting the Southwesterly 15 feet, to the Jefferies in November of 1971, Book 9870, Page 739, which resulted in a two foot remainder between the two properties that is apparently still owned by the Bentsons. It is First American's position that the legal description on your deed correctly reflects your interest in the subject property. Whether the Bentsons intended to retain or sell the two feet in question is not a matter to be determined by First American. The legal description insured by First American is based upon the information disclosed in the public record. Based on the public record, First American takes the position that your legal description is correct and therefore there is no need to correct your deed or title policy. Based upon the above, your claim must be denied. If you have any additional information you believe would impact First American's decision in this matter, please forward it to my attention. Also, pursuant to California's Unfair Claims Settlement Practices Regulations (10 Cal.
